Davis Family Limited Partnership ("Grantor") is the owner of the following described land lying in the City of Little Rock, Pulaski County, Arkansas: The East '/2 of Tract 7, Hillvale Addition to the City of Little Rock, Pulaski County, Arkansas, less and except that portion deeded to the City of Little Rock in Instrument No. 78-33036, in the records of the Circuit Clerk of Pulaski County, Arkansas, that part of Tract 10, Hillvale Addition lying North of the North right-of-way line of Chenal Parkway, and that portion of Old Markham Street lying South of and adjacent to the East'/z of Tract 7, Hillvale Addition, closed by Little Rock City Ordinance No. 16092, filed for record as Instrument No. 91-56852, in the records of the Circuit Clerk of Pulaski County, Arkansas, all being more particularly described as: Commencing at the Northwest corner of the East '/z of said Tract 7; thence S 00' 44' 12" W along the West line of the East '/2 of Tract 7, 120.0 ft. to the point of beginning (measured S 00' 57' 58" W, 121.07 ft.); thence S 70° 46' 38" E, 337.73 ft. to a point on the West right-of-way line of Gamble Road; thence S 00' 52' 5 1 " W along the west right-of-way line of Gamble Road 384.74 ft. to a point on the North right-of-way line of Chenal Parkway; thence in a westerly direction along the North right-of- way line of Chenal Parkway the following courses: S 89' 00' 28" W, 134.46 ft.; N 86' 36' 56" W, 185.13 ft. to a point on the West line of the East '/2 of Tract 7, Hillvale Addition extended; thence N 00' 44' 12" E, 487.33 ft. to the point of beginning, containing 140,428 sq. ft. or 3.2238 acres more or less. —.01 THAT, Grantor has caused said land to be surveyed and a plat (the "Plat") thereof made, which is identified by the title of Plat of Lots 1 & 2, Gamble Plaza, an addition to the City of Little Rock, Pulaski County, Arkansas. This Bill of Assurance and the Plat have been signed by Grantor and the Plat bears a certificate of approval, executed by the Little Rock Planning Commission and is recorded in the office of he Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, in Plat Book , Page and the Grantor does hereby make this Bill of Assurance. HEREAFTER, conveyances and descriptions of the property as shown on the Plat shall be a proper and sufficient description thereof. Lots in Gamble Plaza Addition to the City of Little Rock, Pulaski County, Arkansas, shall be conveyed by Grantor and shall be acquired by the Grantees thereof, subject to the covenants contained herein, in the Plat and in any Restrictive Covenants, existing Bills of Assurance or other documents governing the use and development of the herein -described property. UTILITY EASEMENTS: There are shown on said Plat certain easements for utilities which Grantor hereby donates and dedicates to and for the use of public utilities with the right hereby granted to the person, forms or corporations engaged regarding the supplying of such utilities to use and occupy such easements, and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. The filing of the Plat and this Bill of Assurance for record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall be a valid and complete delivery and dedication of the easements subject to the limitations herein set out. CROSS ACCESS EASEMENTS: There are shown on said Plat certain cross access easements. Grantor hereby grants reciprocal non-exclusive easements on the areas designated as cross access easements to the owners of Lot 1 and Lot 2, their respective successors and assigns, business patrons, invitees, licensees, customers, employees and tenants; limited, however, for purposes connected with or incidental to any use then being made of such parties' property and for furnishing access and the right of access between public streets and any parking areas situated on Tract 1 and Tract 2. TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect until December 31, 2050, except that, unless a majority of the owners vote to amend or terminate this instrument, the N provisions hereof will automatically extend for successive ten (10) year periods. A majority of owners of the properties described herein may, from time to time, amend this Bill of Assurance. RESTRICTIONS: Grantors and all future grantees of the property described in this Bill of Assurance and the Plat specifically agree all ordinances of the City of Little Rock shall be strictly adhered to and followed and, should the Plat or this Bill of Assurance be contrary, in any way, to the ordinances adopted by the City of Little Rock, Arkansas, from time to time, such ordinances shall have precedence. 1 WITNESS WHEREOF, Grantor does hereby execute this Bill of Assurance on this d�y of August, 2005. .
