Dear Donna:
My name is Andy Francis, and I represent Charles Hinson and Bottom Line, Inc., the applicant
for the above -referenced matter. This letter is to notify the City of Little Rock that Pulaski
County, Arkansas, has approved the "No -Rise" analysis prepared for the Two Rivers Harbor
Subdivision.
The applicant engaged the engineers at FTN Associates, Ltd. ("FTN"), to perform the "No -Rise"
analysis for this subdivision. FTN performed this analysis, and on June 30, 2005, FTN notified
the applicant that the study showed that the proposed development will not create any adverse
impact on the Base Flood elevations within the floodway in the vicinity of the project. The
applicant forwarded this information to Mr. Sherman Smith, Director of Public Works for
Pulaski County. Mr. Smith has accepted the No -Rise analysis.
It is my understanding that.this resolves favorably the only remaining issue for this item, and that
the Planning Commission will hold the public hearing on this item at its July 21, 2005 meeting. I
hope that this application will receive a recommendation of approval from staff. If not, please let
me know and I will be happy to answer any questions staff or the Commission have prior to the
meeting.

RE: Bottom Lire, Inc. — Land Exchange for Two Rivers Harbor Access Road
Dear Carla:
Pursuant to air previous discussion, eiielosed please f rid a copy of a 1'amel Map for the Two
Rivers Harbor development showing the land proposed to be exchanged between Bottom Line,
Inc. and Pulaski C:oanty regarding the abovc-referenced matter. Also enclosed aria copies of two
deeds, a Warranty Deed and a Quitclaim Deed, both from Bottom Line, Tsc. to Pulaski County.
The Parcel Map describes five parcels. Parcel l is a portion of the existing easement conveyed
from Pulaski County to Bottom Linz, Inc. on Apri: 30, 2004 by ]nsttmment Numbar 2004047621.
A copy of this Easement is enclosed for your reference. Parcel 2 is another portion of this same
easement. Both Parcels I and 2 convey all of the second part of this easement (the portion of the
description after the word "AND") with the exception of the parcel described as Parcel 3. I
propose using a Quitclaim Deed for this transfer hocauso the only interest Bohan Line holds is
an easement from the County.
Parcel No. 3 will be conveyed by the County to Bottom Line. I would propose using a Warranty
Deed fa- this iransfer. While the County has previously conveyed an easement to Bottom Line
for Tract 3, the Warranty Deed for Tract 3 will merge the title in Bottom Line, Iuc. and should
not create any problems for the County with its Warranty.
Parcel No. 4 was not subject to a prior easement, so I would propose that the County use a
Warranty Deed to transfer this property to Bottom Line.
Parcel No. 5 is the very rastern end of the Bottom Line property. Bottom Line feels that this
would be an ideal place forthe County to allow users of the horse trail to have access to the
Arkansas River and a place to rest. Bottom Line will be happy to provide an extension of its
water line from the residential developrnert to this area and would like to make some
arrangement with the County for payment for any use of the water.

As you can see, the total area conveyed from ine County to Bottom Linc is approximate,y .73
acres. The area conveyed from Bottom Line to the County is approximately 1.24 acres, so the
County is getting almost twice as Much land as it is giving. Also, Bottom Line is. providing Iand
to the County which has frontage on the Arkansas River and is extremely valuable property. I
hope the County will see that :his is a murma?ly beneficial transaction for all parties and one
which provides the Cot u.y with some truly unique proper*y that will allow users of the horse tria!
to access the Arkansas River.
Please review these documents and call the with any questions. If everything meets with your
approval, please taka whatever actions are necessary to see that this proposed exchange complies

Dear Mr. Hinson:
In fulfillment of our contract for the referenced analysis, we are submitting a copy of a summary
report prepared regarding that analysis and an accompanying comparison table listing the pre -
and post -construction Floodway elevations for the Arkansas River within the affected reach of
the River. FTN Associates, Ltd. (FTN) neither designed the proposed subdivision nor the
prepared the proposed grading plan. The information provided by you and your contractor was
used to hydraulically evaluate the probable effects of the proposed subdivision on the Floodplain
and Floodway Water Surface elevations in the vicinity of the proposed construction. The
resulting water surface elevations are not meant to confirm or change any published Flood
Insurance Study information but are to be used as comparison of existing and proposed
conditions in the impacted reach. We have prepared a "No -Rise" Certification for the proposed
subdivision referenced above based on the results of this study.
We do not encourage nor endorse the development of the proposed subdivision referenced above
by the issuance of the enclosed "No -Rise" Certification nor by any part of the report concerning
our analyses. Structures proposed to be constructed within the proposed development should be
designed by a licensed Professional Engineer to withstand the flood forces that may occur within
the impacted reach of the Arkansas River. It should be realized by you that the proposed location
of the subdivision lies within the 100-year Floodplain and Floodway of the Arkansas River and
may not be habitable should such a flood event occur within this reach of the Arkansas River.
That information should be provided to all prospective buyers within this proposed development.
We are also forwarding copies of this letter and its attachments to the Little Rock District of the
Corps of Engineers and the Pulaski County Floodplain Administrator.

Summary Report of
"NO -RISE" Modeling Analysis
Two Rivers Harbor Subdivision
FTN No. 7300-006
The objective of this project was to perform a hydraulic modeling analysis of the
proposed Two Rivers Harbor Subdivision to be located on the property of Mr. Charles Hinson in
western Pulaski County. This analysis was necessary because the proposed development is to be
located within the Floodway of the Arkansas River in Pulaski County, Arkansas. The analysis
was performed to determine whether an increase in the floodplain or floodway water surface
elevations would be expected to occur due to the proposed development. In the event that the
proposed development would cause a rise in the water surface elevation, then alternatives would
need to be examined to eliminate the increase. The hydraulic model used in this study was the
US Army Corps of Engineers LRD-1 backwater model as it is the current "effective" model of
the Arkansas River for the Pulaski County Flood Insurance Study.
The latest LRD-1 backwater FLOODPLAIN AND FLOODWAY data files were
obtained from the Little Rock District (LRD) Corps of Engineers Hydrology & Hydraulics
Branch. In order to more accurately model the water surface elevations at the proposed
construction sites, cross sections were developed within the proposed development at the
locations of the proposed houses. The channel sections of these cross sections were linearly
interpolated from existing LRD-1 cross sections located upstream and downstream from the
study area. The elevations of the right overbank area for the added cross sections were
determined from both new surveys performed by Mr. Donald Brooks and from Pulaski Area
Geographical Information System contour map data. The left oberbank within the Project reach
terminated at the top of bank and therefore was interpolated from the two original bounding
LRD-1 sections. The Floodway boundaries were determined based on what was represented at
the existing upstream and downstream cross sections contained in the latest LRD-1 model and as
represented on the effective Flood Insurance Rate Map (FIRM). Cross sections were developed
immediately upstream and downstream of each proposed house. These added cross sections were
used to develop the pre -project conditions models, which incorporates the existing topography
on that site into the LRD-1 models (Floodplain and Floodway).

The pre -project conditions model was then copied and revised to reflect post -project
conditions. A site plan with the proposed locations of the seven houses was developed by
Pumphrey Architecture and provided by Mr. Hinson. The Two Rivers Harbor Subdivision is
proposed to be developed with no change in existing grade, other than the addition of the
proposed structures. The outlines of the proposed houses were provided by Pumphrey
Architecture and are shown on the attached Work Map. For post -project conditions, the proposed
structures were added to the LRD-1 models.
After the LRD-1 analyses were performed for both pre-, and post -project conditions
models, the output data was tabulated. It was determined that there was no detectable change in
the floodplain and floodway water surface elevation due to the proposed development if the
development is constructed as proposed. The attached table summarizes the water surface
elevations and energy grade line elevations for these two scenarios for the 100-year discharge for
the affected reach of the Arkansas River of 480,000 cfs.

Dear Carla:
Pursuant to our previous discussion, enclosed please find a copy of a Parcel Map for the Two
Rivers Harbor development showing the land proposed to be exchanged between Bottom Line,
Inc. and Pulaski County regarding the above -referenced matter. Also enclosed are copies of two
deeds, a Warranty Deed and a Quitclaim Deed, both from Bottom Line, Inc. to Pulaski County.
The Parcel Map describes five parcels. Parcel I is a portion of the existing easement conveyed
from Pulaski County to Bottom Line, Inc. on April 30, 2004 by Instrument Number 2004047621.
A copy of this Easement is enclosed for your reference. Parcel 2 is another portion of this same
easement. Both Parcels 1 and 2 convey all of the second part of this easement (the portion of the
description after the word "AND") with the exception of the parcel described as Parcel 3. I
propose using a Quitclaim Deed for this transfer because the only interest Bottom Line holds is
an easement from the County.
Parcel No. 3 will be conveyed by the County to Bottom Line. I would propose using a Warranty
Deed for this transfer. While the County has previously conveyed an easement to Bottom Line
for Tract 3, the Warranty Deed for Tract 3 will merge the title in Bottom Line, Inc. and should
not create any problems for the County with its Warranty.
Parcel No. 4 was not subject to a prior easement, so I would propose that the County use a
Warranty Deed to transfer this property to Bottom Line.
Parcel No. 5 is the very eastern end of the Bottom Line property. Bottom Line feels that this
would be an ideal place for the County to allow users of the horse trail to have access to the
Arkansas River and a place to rest. Bottom Line will be happy to provide an extension of its
water line from the residential development to this area and would like to make some
arrangement with the County for payment for any use of the water.

As you can see, the total area conveyed from the County to Bottom Line is approximately .73
acres. The area conveyed from Bottom Line to the County is approximately 1.24 acres, so the
County is getting almost twice as much land as it is giving. Also, Bottom Line is providing land
to the County -which has frontage on -the Arkansas River and is -extremely valuable -property.- I
hope the County will see that this is a mutually beneficial transaction for all parties and one
which provides the County with some truly unique property that will allow users of the horse trial
to access the Arkansas River.

approval, please take whatever actions are necessary to see that this proposed exchange complies
with the requirements of Arkansas Code Annotated 14-16-105. I will be happy to provide you

County, Arkansas, has approved the "No -Rise" analysis prepared for the Two Rivers Harbor
Subdivision,
The applicant engaged the engineers at FTN Associates, Ltd. ("FTN-), to perform the "No -Rise"
analysis for this subdivision. FTN performed this analysis, and on dune 30, 2005, FTN notified
the applicant that the study showed that the proposed development will not create any adverse
impact on the Base Flood elevations wlthin the floodway in the vicinity of the project. The
applicant forwarded this information to Mr. Sherman Smith, Director of Public Works for
Pulaski County. Mr. Smith has accepted the No -Rise analysis.
It is trey understanding that this resolves favorably the only remaining issue for this item, and that
the Planning Commission will hold the public hearing on this iter:i at its July 21, 2005 meeting. l
hope that this application will receive a recommendation of approval from staff, if not, please let
me know and I will be happy to answer any questions staff or the Commission have prior to the
meeting.

Submitted herewith are four (4) copies of the revised preliminary plat for the above referenced
project. The project has been revised to only have five lots instead of six. A portion of the
ground labeled as Tract 6 will remain as open space will a portion of the property labeled as
Tract 7, will be deeded to the County to become part of Two Rivers Park to provide them with
direct access to the banks of the Arkansas River.
Sewer treatment will be from individual septic systems. The septic field for Tract 5 will be
located on the portion of the property labeled as Tract 8. A copy of the approval letter from
the Arkansas Department of Health has been enclosed.
All of the comments received from the subdivision review committee have been addressed
with no outstanding items. The Flood Study certifications prepared by FTN & Associates is
being forwarded under separate cover to both your office and the County. Therefore we
request that this item be placed on the agenda for the next available planning commission

Based on the information submitted and a site evaluation, this project is granted
preliminary approval for development utilizing individual subsurface sewage disposal
systems with the following provisions: . "
This preliminary approval is based upon the statements and representations made
in the submitted soil data, plans, and specification. In case any statements or
representations in the aforementioned documents are found to be incorrect, this
approval may be revoked.
2. There shall be no deviation from the plans and specifications unless revised plans
and specifications have first been submitted for review and consent given.
3. Further subdivision of any lot or lots will void this approval. Revised plans with
complete soil suitability data will be required for any change made. These
provisions must be included with the plans when filed and recorded at the county
court house. It shall be the responsibility of the developer to notify the property
buyers that further subdivision of the lots in this project may preclude the issuance
of a septic system permit on one or all parcels involved in the division.
4. Septic system locations, loading rates and lineal footage per bedroom for each lot
must conform to the recommendations for that lot as outlined in the data submitted.
It shall be the responsibility of the developer to inform all lot buyers of the
restrictions on septic system locations, number of bedrooms, and house locations for
their individual lot.

5. Water system for the subdivision must be approved by a representative of the
Arkansas Department of Health Drinking Water Program. No individual sewage
disposal permits will be issued prior to water system approval.

approval is granted.

MAUMELLE Your correspondence to Pulaski County Planning has been forwarded to this office for
NORTH LITTLE ROCK response. In your letter of February 25, 2005 you notified the Pulaski County Planning
Department of your intent to replace gravel on the drive at the end of Isbell Road. You
SHERWOOD also inform planning that you will be installing a privacy gate at the beginning of Isbell
WRIGHTSVILLE Road. Isbell Road is a private road, and may be gated; however, you may not block
Pulaski County's access to the easement that you have been granted or to any property
owned by the County.
With regard to your intent to replace gravel on the drive at the end of Isbell Road, an
inspection reveals that you have in fact placed gravel beyond the existing drive. The
UNINCORPORATED gravel road that you have installed clearly encroaches on the county's property in Two
AREA Rivers Park. Pulaski County's property line was clearly marked in this area and your
gravel road is visibly to the south of the markings. Not only is the road on Pulaski
600 SQUARE MILES County's property, it does not conform to the preliminary plat that you have filed. This
letter is being written to inform you that you must remove the gravel that you have
installed upon Pulaski County's property immediately. If the gravel is not removed
within thirty (30) days from the date of this letter, Pulaski County will remove the gravel
and bill you for the expense incurred in the removal. Further, you should be aware that
Pulaski County is prepared to take any legal action necessary to protect our property
MILITARY located in Two Rivers Park.
BASES
Finally, as you are aware, the property in question is located within the floodway.
LRAFB Because of the property's location within the floodway, it is necessary for you to comply
CAMP ROBINSON with FEMA requirements to perform flood studies when making alterations to the
property, even that portion of the road that is located on your own property. According to
our records, no flood studies were performed before the new road was built.

Per the discussion at the subdivision committee meeting last Thursday, February 10, 2005, the
following is an update on the current status of the regulatory issues surrounding the above
referenced project. The two major issues with the proposed project are the sewering of the lots
and the development being in the floodway of the Arkansas River. All other comments from the
review are of a minor nature and cause no delays.
David Meints of Meinco, LLC, has conducted the fieldwork required to get Health Department
approval for Tracts 1, 2, and 3. As stated in the subdivision committee meeting, the plat will be
revised to only address Tracts 1-3. The Owner has engaged the services of FTN Associates to
do the required hydraulic modeling for the floodway issue. We are requesting a firm schedule
from FTN for when they will have the study completed and issue the needed certificate.
Due to the delays discussed above, we would like to request a six (6) week deferral for this
project to the March 26, 2005, public hearing. 'We believe that this will allow enough time to
have all of the issues resolved and the project will be ready to proceed. If you have any

Two Rivers Harbor Subdivision
Dear Donna:
Submitted herewith are eighteen (18) copies of the preliminary plat and a preliminary plat
application for the above referenced subdivision. The purpose of this submittal is to subdivide
a 9.66 acre tract of residential zoned property into six (6) large estate type lots ranging from
0.65 acres up to 2.61 acres.
This property is outside of the city limits of Little Rock, but does reside inside its planning
jurisdiction. We have meet and coordinated with Mr. Sherman Smith of Pulaski County about
the development and the fact that the property does lie within the floodway of the Arkansas
River. Mr. Smith has been allowed several other residences to be built just west of this tract
by getting a 'No Rise/No Impact" statement for the proposed development. The
developerlowner is currently working with our firm and FTN to obtain such a certificate. The
certificate will be received prior to any construction or request for a final plat.
No public sewer is currently available for this project. The Developer will install and operate a
small package treatment plant for the project instead of doing septic tanks and fields. This
plant will be completed and accepted prior to issuance of a final plat.
Approval is requested pursuant to Arkansas Law on City Planning, Act 186 of 1957, Acts of
Arkansas, and section 36 of the Little Rock Code of Ordinances. If you have any questions
