BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That a variance from various lot design standards of Chapter 31 of the Code of Ordinances is granted to provide for variances of certain requirements within the Subdivision Regulations of the City of Little Rock for the Islamic Center Subdivision Preliminary Plat (5-1460) as follows: Subsection A. That variances are granted from the provisions of Chapter 31, Section 31-232(f) to allow the development of a pipe stem; Lot 23 of Islamic Center Subdivision Preliminary Plat. Subsection B. That variances are granted from the provision of Chapter 31, Section 31-2 to allow an increased depth of the pipe stem and to allow a reduced width of the pipe stem; Lot 23 of Islamic Center Subdivision Preliminary Plat. SECTION 2. This ordinance shall take effect thirty (30) days from and after its passage. Sincerely, Donna James, AICP Subdivision Administrator OFFICE OF THE CITY MANAGER LITTLE ROCK, ARKANSAS BOARD OF DIRECTORS COMMUNICATION OCTOBER 5, 2004 AGENDA Subject An Ordinance establishing variances from the Subdivision Ordinance for the Islamic Center Preliminary Plat (S-1460) located on the Southeast corner of West 40'' Street and Potter Street Action Required gOrdinance Resolution Approval Information Report Submitted By Bruce Moore City Manager SYNOPSIS The applicant is requesting a variance from the Subdivision Ordinance to allow the development of a pipe stem lot and to allow an increased depth of the pipe stem lot. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested variance. The Planning Commission voted to recommend approval of the requested variance, as recommended by Staff, by a vote of 9 ayes, 0 noes and 2 absent. CITIZEN The Planning Commission reviewed the proposed variance PARTICIPATION request along with a rezoning request to PD-R at its August 26, 2004 meeting. There were registered objectors present. All abutting property owners of the site, all residents within 300 feet, who could be identified, the John Barrow Neighborhood Association and the Westfield Neighborhood Association were notified of the Public Hearing. BACKGROUND The applicant has indicated the development will be constructed with 22 single-family homes, a mosque and an education building on a six acre tract. The site plan indicates a 25-foot building setback will be provided on the BACKGROUND CONTINUED front of all the proposed lots and a 20-foot rear yard setback is being proposed. The applicant has indicated a ten foot side yard setback will be maintained. The average lot size proposed is 6313 with the minimum lot size proposed as 6024. The proposed subdivision will be developed in five phases. The first phase will consist of the development of the single-family homes along West 40t' Street. The second and third phase will include the construction of Lots 7 and Lots 8 and 9 and 10. The fourth phase will include the construction of the school and mosque. The mosque and school are proposed to be located on Lot 23, a pipe stem lot. The applicant is requesting a variance from the Subdivision Ordinance to allow the development of the lot as proposed. The final phase will be the development of the lots along the proposed cul-de-sac street. Please see the attached Planning record and site plan for the development proposal and the recommendation.
