WHEREAS, William and Katherine McMurry are the sole owners of the following

more particularly described as follows:
Commencing at the Northwest corner of said NW 1/4 NW 1/4, Section 20, thence North

NOW, THEREFORE, WITNESSETH:
That we, the said owners, hereinafter termed grantor(s), have caused said tract of land to
be surveyed by Donald -Brooks, Registered Land Surveyor and the Engineering prepared
by Robert D. Holloway, Registered Professional Engineer, and a plat thereof made which
is identified by the title Lots 1 and 2, Kathy's Planned Commercial Development
Addition, Little Rock, Pulaski County, Arkansas and the date October 8, 2004 and by the
signature of the said Land Surveyor and Engineer and the said grantor(s), and bears a
Certificate of Approval executed by the Little Rock Planning Commission, and is on
record in the Office of the Circuit Clerk and ex-officio Recorder of Pulaski County,
Arkansas, in Plat Book _ Page t) and the grantor(s) do hereby make this
Bill of Assurance.
The grantor(s) do hereby certify that they have platted said real estate in accordance with
said plat. The lands embraced in said plat shall be forever known as designed on said
plat; and every deed of conveyance for said property shall use this designation.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit Clerk
and ex-officio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of the streets and easements shown on the said plat.
All buildings constructed on said lots shall be constructed no nearer to the street than the
building line shown on the plat, and all buildings shall be constructed in conformance
with the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.

VARIOUS LOT DEVELOPMENT STANDARDS OF
CHAPTER 31 OF THE CODE OF ORDINANCES OF THE
CITY OF LITTLE ROCK, ARKANSAS; PROVIDING FOR A
VARIANCE TO ALLOW FOR THE DEVELOPMENT OF A
PIPE STEM LOT AND TO ALLOW AN INCREASED
DEPTH OF A PIPE STEM LOT FOR KATHY'S
SUBDIVISION PRELIMINARY PLAT (S-1459), LOCATED
AT 13810 COLONEL GLENN ROAD.
BE IT ORDAINED BY THE; BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That a variance from various lot design standards of Chapter 31 of
the Code of Ordinances is granted to provide for variances of certain requirements within
the Subdivision Regulations of the City of Little Rock for Kathy's Subdivision
Preliminary Plat (S-1459) as follows:
Subsection A. That variances are granted from the provisions of Chapter 31,
Section 31-232(f) to allow the development of a pipe stem; Lot 3 of Kathy's Subdivision
Preliminary Plat.
Subsection B. That variances are granted from the provision of Chapter 31,
Section 31-2 to allow an increased depth of the pipe stem; Lot 3 of Kathy's Subdivision
Preliminary Plat.
SECTION 2. This ordinance shall take effect thirty (30) days from and after its
passage.

SYNOPSIS
The applicant is requesting a variance from the
Subdivision Ordinance to allow the development of a pipe
stem lot and to allow an increased depth of the pipe stem
lot.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the requested variance. The
Planning Commission voted to recommend approval of the
requested variance, as recommended by Staff, by a vote of
9 ayes, 0 noes and 2 absent.
CITIZEN
The Planning Commission reviewed the proposed variance
PARTICIPATION
request along with a rezoning request to PD-C at its
August 26, 2004 meeting. There were two registered
objectors present. All property owners located within 200-
feet of the site and all residents within 300 feet, who could
be identified were notified of the Public Hearing. There is
not an active neighborhood association located within the
area.
BACKGROUND
The applicant is also proposing the creation of a three lots
plat in conjunction with a proposed planned development
to recognize existing uses located on the site at 13810
Colonel Glenn Road (File No. Z-7698). The applicant has

indicated two of the lots will contain non-residential uses
with the third remaining zoned R-2, Single-family and
containing the applicant's residence.
