I None. Staff recommends approval of the requested variance. The Planning Commission voted to recommend approval of the requested variance by a vote of 9 ayes, 0 noes and 2 absent. The Planning Commission reviewed the proposed variance request at its March 1, 2007, meeting. There were no registered objectors present. All abutting property owners and the Gibralter Heights/Point West/Timber Ridge Neighborhood Association were notified of the public hearing. a BACKGROUND Various Planning Commission and Board of Directors actions have taken place on this site including rezonings and preliminary plat approvals. The previously approved preliminary plats have expired or have been voided due to later actions. The applicant is now seeking approval of a preliminary plat for this site to allow the creation of a seven lot plat with shared driveways and a common access easement on the common lot line of Lots 2 and 3 and the common lot line of Lots 3, 4 and 5. The driveways will allow access to Lot 6, a lot being created without public street frontage. Lot 6 will require a variance from the Subdivision Ordinance (Section 31-231) to allow the creation of a lot without public street frontage. Private agreements will be made between the various lots owners to provide cross access and parking within the development. As separate items on this agenda the applicant is requesting a revocation of the current PCD zoning (Z-6554-E) and a rezoning request (Z-6554-F) from R-2, 0-3 and C-3 to C-3 and O-3. Markham St. Little Rock, AR 72201 Ms. James, Attached please find eighteen copies of the preliminary plat and six copies of the rezoning request for the above referenced project. This property contains 13.9 acres located at the northwest corner of Bowman and Kanis Roads. With this filing the developer would like to request a revocation of the PCD as approved under Ordinance No. 19,479. The developer requests that the property return to the underlying zoning. The preliminary plat indicates 7 lots with shared driveways and a common access easement on the common line of lots 2 and 3 and the common line of lots 3, 4 and 5. This driveway will allow access to lot 6. This lot will require a variance for a lot without public street frontage. Private agreements will be made between the various lot owners to provide cross parking and access within the development. The owner is also requesting three rezonings within the development. The request for lot 7 is R-2 to 0-3, with lot 5 going from 0-3 to C-3 and a small triangle on the western end of lot 1 rezoning from R-2 to C-3. The developer will dedicate all right-of-way and construct all street improvements as required by the Master Street Plan. The developer is requesting a variance for advanced grading and a cut slope on the western property line up to 40 ft. vertically rather than the allowed 30 ft.
