RATIFICATION OF DECLARATION OF RESTRICTIONS AND COVENANTS
FOR LOTS 4-10 and LOT 12, THE VILLAGE AT BRODIE CREEK ADDITION
KNOW ALL MEN BY THESE PRESENTS:
THAT, VILLAGE AT BC, LLC, an Arkansas limited liability company (hereinafter called the "Grantor"),
as the owner of Lots 4-10 and Lot 12, The Village at Brodie Creels Addition, City of Little Rock, Pulaski County,
Arkansas (the "Pro ei "), as shown on Final Plat of record as Instrument Number , recorded on
2023, in the records of Pulaski County, Arkansas (the "Plat") and successor in interest as Grantor
under that certain Declaration of Restrictions and Covenants The Village at Brodie Creek Addition of record as
Instrument Number 2012084291, recorded on December 21, 2012, and that certain Ratification of Declaration of
Restrictions and Covenants for Lot 12, The Village at Brodie Creek Addition of record as Instrument Number
2023009718, recorded on February 22, 2023, in the records of Pulaski County, Arkansas (collectively, the "Bill of
Assurance"), hereby ratifies and affirms the Plat and Bill of Assurance covering the Property. The foregoing
ratification shall be deemed a covenant running with the land and the covenants and restrictions set forth in the Bill
of Assurance and this Ratification shall be binding upon the Property and the Grantor's successors in interest as
owners of the Property.
The property embraced in the Plat shall be forever known as "Lots 4-10 and Lot 12, The Village at Brodie
Creek Addition, an addition to the City of Little Rock, Pulaski County, Arkansas" (herein each a "Lot" or
collectively, the "Lots"), and any and every deed of conveyance of any Lot in The Village at Brodie Creek Addition
describing the same by the number shown on said Plat shall always be deemed a sufficient description thereof.
In addition to the Property being subject to the Bill of Assurance, Grantor hereby donates and dedicates to
the public the additional right of way along Bowman Road and the streets and right of way shown as Colonel Glenn
Plaza Drive and Topgolf Way on said Plat to be used as public streets. In addition to the said streets, there are shown
on said Plat certain fifteen foot (15') easements for utilities on each Lot which Grantor hereby donates and dedicates
to and for the use of public utilities ("Public Utilities"), the same being, without limiting the generality of the
foregoing, electric power, gas, telephone, water, sewer and fiber and cable television and/or internet service with the
right hereby granted to the persons, fines or corporations engaged in the supplying of such utilities to use and
occupy such easements, and to have free ingress and egress therefrom for the installation, maintenance, repair and
replacement of such utility services.
Each Lot shown on the Plat shall be subject to the building setback lines and other restrictions which affect
the Lot as shown on said Plat.
The filing of this Ratification Bill of Assurance and the Plat for record in the office of the Circuit Clerk and
Ex Officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the streetst and
easements subject to the limitations herein set out and City of Little Rock's acceptance of such dedication-.T,

These covenants and restrictions shall not be amended, canceled or supplemented unless an instrument
signed by the Grantor (if still an owner of any portion of the Property) and all of the then owners of all of the Lots
shown on the Plat is placed on record agreeing to change the covenants and restrictions in whole or in part, and, if
required, any change must be approved by the City of Little Rock's Planning Commission.
In the event of any attempt to violate any of the covenants or restrictions herein, before the expiration date
hereof, it shall be lawful for any person or persons owning a Lot or Lots in said addition to prosecute any
proceedings at law or in equity against the person or persons violating or attempting to violate any such covenant or
restriction, and either to prevent him or them from so doing or to recover damages or other dues for such violation.
The invalidation of any one of these covenants or restrictions by judgment or court order shall in no wise
affect any of the other provisions, which shall remain in full force and effect.

Brian,
I just received approval of the street lighting plans from Traffic Engineering Division this morning. Therefore, the final
plat is recommended to be recorded with Pulaski County. Coordinate with Mr. Moore on obtaining final
signatures. Before obtaining the final signatures and recording the final plat with Pulaski County, submit to the
Department staff the 100% performance bond for the remainder of the work to be completed within the public right of
way on Topgolf Way and Bowman Road.

Brian,
Looks good. Submit the 100% performance bonds for the work left to be completed to Department engineering staff at
your earliest convenience. Staff is still waiting on Traffic Engineering to complete their review of the street lighting plans.
As a reminder, staff will need 50% maintenance bonds in the future for all street and drainage infrastructure work
completed within the public right of way after final inspection and acceptance by staff.

The easement between lots 10 and 11 appear to be different widths on the As -Built and proposed plat.
We see a 20' easement on the As Built but a 15' easement on plat. I'm trying to make sure I know which
is correct to verify the sewer main is centered within the easement.
