NOW, THEREFORE, WITNESSETH:
That I/We, the said Owners hereinafter
termed grantor(s), have caused said tract of land to be surveyed by Randy S. Alberius
Registered Professional Engineer/Land Surveyor, and a plat thereof made -which is identified by
the title Lot 28-R,_a.Replat of Lot 28, Southern Hills, a Subdivision in Pulaski County,
and the date October 10, 2003 and by the signature of the said engineer/surveyor and the said
grantor(s), and bears a Certificate of Approval executed by the Little Rock Planning Commission, and is on
record in the Office of the Circuit Clerk and ex-officio Recorder of Pulaski County, Arkansas in Plat
Book Page !&— and the grantor(s) do hereby make this Bill of Assurance.
The grantor(s) do hereby certify that they have replatted said real estate in accordance with said plat.
The lands embraced in said plat shall be forever known as designed on said plat; and every deed of conveyance
for said property shall use this designation.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit Clerk and ex-oflicio
Recorder of Pulaski County shall be a valid and complete delivery and dedication of the streets and easements
shown on the said plat.

The purpose of this instrument is to amend the current Building Setback to allow for the
encroachment of the House as authorized by the Board of Adjustment at its meeting on December 23, 2003.
All buildings constructed on said lots shall be constructed no nearer to the street than the building
line shown on the plat, and all buildings shall be constructed in conformance with the Building Code and
Zoning Ordinance of the City of Little Rock, Arkansas.

If a variance application is approved by the Board of Adjustment, all permits necessary for the
initiation of work shall be obtained within two (2) years from the date of approval, unless an extension of
time is granted by the Board. Otherwise. the Board zpp:oval of the application shall be considered void.
According to the City's Zoning Ordinance Section 36-70:
"Appeals from the decision of the Board of Adjustment shall be filed with the
appropriate court of jurisdiction. This tiling must occur within thirty (30) calendar days
of the action by the Board of Adjustment_"
