Prior to construction, a Grading permit and a Special Flood Hazard Development permit are required to be obtained from Public Works. The project is located in sections 13 and 14, T. 1 N., R. 12 W., Little Rock, Pulaski County, Arkansas. After reviewing your data forms, topographic maps, aerial photographs, Pulaski County Soil Survey, and conducting a site inspection of the subject property, I concur with your findings that 0.41 acres of wetland exist on the subject property as defined by the 1987 Corps of Engineers Wetland Delineation Manual. Also, an unnamed drainage channel identified on the subject property is considered waters of the United States. This wetland delineation is valid for a period of five years from the date of this letter unless new information warrants revision of the delineation before the expiration date. Based on a written verification within the submitted permit application and a conversation with you, it was confirmed that the permit applicant, JPM Group, Inc., will completely avoid impacis to the 0.41 acres of Section 404 wetlands and the unnamed drainage channel on the subject property. Therefore, the construction of the proposed Stonewood Apartments at the subject location does not require a Section 404 Department of the Army permit. Please note the large wetland areas immediately west and north of the subject property. These wetland areas are considered waters of the United States. Please advise the permit applicant that if any future activities involve the placement of dredged or fill material into the 0.41 acres of wetland and/or the unnamed drainage channel on the subject property or in any waters of the United States, a Section 404 Department of the Army permit will be required and a permit application will need to be submitted to this office for review prior to beginning work. -2- This permit action is based upon a Corps of Engineers determination that the subject property contains areas within the jurisdiction of the Department of the Army regulatory program.
