Stonecreek Subdivision, Phase 1
Dear Donna:
Submitted herewith are four (4) copies of the proposed replat for the above referenced lots.
Following are brief explanations of the requested replats:
Lots 22R & 23R
During the construction of the fence at the rear of lots 22R and 23R of Stonecreek, it was
discovered that the rear line of the lots was not contiguous with the side lot line of Lot 17 of
Heatherbrae Phase 2 as it should have been. Investigation should that a strip of land
approximately 0.03 acres in size, had been left between the plats of Heatherbrae Phase 2 and
Stonecreek Phase 1. This proposed replat will take that strip of land and add it to the rear of
Lots 22R and 23R.
Lots 8R —1 OR
The newly constructed house on Lot 8R was turned to face Glen Valley Drive rather than
Clancy Court. Once constructed the house was left with a very shallow rear yard. To improve
this situation, the Developer has decided to take the south 42 feet of Lot 9R and add it to Lot
8R to create a larger rear yard. The remainder of Lot 9R is being added to Lot 1 OR.
The net effect of the proposed changes is the loss of one lot. Please forward copies of the
enclosed drawings to the appropriate parties and inform me of any needed changes. If you
have questions or comments, please do not hesitate to call.

WHEREAS, on May 20, 2005, A. S. Rosen & Associates, Inc. and Bill Bosley, Agent,
executed a certain Bill of Assurance which applies to Stonecreek Phase I Addition, an Addition to
the City of Little Rock, Pulaski County, Arkansas, and appears of record in the Office of the
Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, at Instrument Number
2005044603;
- - WHEREAS, on September 26, 2005, A. S. Rosen & Associates, Inc. and Bill Bosley,
Agent, executed an Amendment to Bill of Assurance which applies to Lots 1R-23R Stonecreek
Phase 1 Addition, ari Addition to the City of Little Rock, Pulaski County, Arkansas, and appears
of record in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas,
as recorded at 2005082823;
WHEREAS, A.S. Rosen and Associates, Inc., an Arkansas Corporation, and Bill Bosley,
Agent, are the sole owners of the following described property to wit:

Paragraph 3 of said Bill of Assurance to designate the minimum principal dwelling size allowed
by said Bill of Assurance for dwellings of one and one-half stories.
AND WHEREAS all Bills of Assurance heretofore filed in the Office of the Circuit
Clerk and Ex-Officio Recorder in and for Pulaski County, Arkansas shall otherwise remains in
full force and effect, except as amended by this document.

That we, the said-A.S. Rosen, President, and Bill Bosley, Agent, hereinafter termed
Grantors, hereby modify paragraph 3 to the Bill of Assurance as follows:
3. Minimum Principal Dwelling Size. The floor area of any one-story
dwelling constructed on any lot or part thereof shall be not less than
2400 square feet; the floor area of any one and one-half story
dwelling constructed on any lot or part thereof shall be not less than
2600 square feet; and the floor area of any two-story dwelling
constructed on any lot or part thereof shall be not less than 2800
square feet. In all cases, the floor area shall be the finished heated
and cooled living area of the building within its largest outside
framed dimensions, exclusive of open porches, decks, eaves, carports
and garages, breezeways, terraces, and exterior or secondary
stairways.
