AN ORDINANCE TO VACATE AND ABANDON A PORTION
OF THE PUBLIC RIGHT-OF-WAY LOCATED ON THE
EASTERNMOST END OF GOOCH ROAD, IN THE CITY OF
LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.
8 WHEREAS, a request was made to abandon a portion of the public right-of-way
9 on the easternmost end of Gooch Road, located West of Heatherbrae Phase III,
10 pursuant to the City's general police power authority under Ark. Code Ann. § 14-54-
11 104;
12 WHEREAS, the Board has determined that the abandoning of this portion of the
13 public right-of-way will not have an adverse impact on the adjacent property owners
14 nor the local traffic, and therefore, the right-of-way abandoned by this ordinance is no
15 longer needed for corporate purposes except as otherwise noted below.
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
17 OF THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the
19 portion of the said right of way on the easternmost end of Gooch Road, located West of
20 Heatherbrae Phase III, together with the right of public in general, in the City of Little
21 Rock, Pulaski County, Arkansas.
22 Section 2. The City specifically reserves the existing fifteen -foot wastewater sewer

easement within the former right-of-way.
Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed
in the real estate records of the recorder of the Circuit Clerk in ex
Pulaski County, Arkansas.

Section 3. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged to be invalid or unconstitutional was not originally a part of the
ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

LITTLE ROCK, ARKANSAS.
SECTION 1. That a variance from various lot design standards of Chapter 31 of
the Code of Ordinances is granted to provide for variances of certain requirements within
the Subdivision Regulations of the City of Little Rock for the Glen Valley Subdivision
Preliminary Plat (S-1397) as follows:
Subsection A. That variances are granted from the provisions of Chapter 31,
Section 31-232 (a) to allow lots to develop with a reduced lot width and lots to develop
with a reduced lot area; Lot Lots 1 and 2 of the Glen Valley Subdivision Preliminary Plat.
SECTION 2. This ordinance shall take effect thirty (30) days from and after its
passage.

The applicant is proposing a revision to the previously
approved preliminary plat to allow the subdivision of
10.97 acres into forty-two (42) residential lots which
includes several variance requests.
None.
Staff recommends approval of the requested variance. The
Planning Commission voted to recommend approval of the
requested variance by a vote of 10 ayes, 0 noes and
1 absent.
The Planning Commission reviewed the proposed variance
request at its May 11, 2006, meeting. There were no
registered objectors present. The Westchester/Heatherbrae
Neighborhood Association was notified of the Public
Hearing along with all abutting property owners.
BACKGROUND
On October 16, 2004, the Little Rock Planning
Commission reviewed a request to subdivide 15.4 acres
into 55 single-family lots. The proposal included the
development of the lots with garden style patio homes.
The lots would be developed in three phases with 23 lots in
the first phase (a final plat was executed for this phase on
May 25, 2005), 7 lots in the second phase and 25 lots in the
third phase. The applicant indicated the lots would be
served by a series of residential streets (cul-de-sac's) with
no outlet being planned to Gooch Lane.
On August 18, 2005, the Little Rock Planning Commission
approved a replat of a portion of the development. Lots 1
— 17 located within Phase I were replatted to extend the
side lot lines of Lots 5 —14 across the permanent drainage
easement, reduce the front building line on Lots 1 — 17
from 25-feet to 15-feet and reduce the rear yard setback of
Lots 15 and 16 from 25-feet to 15-feet.
The applicant indicated the reduced setbacks were
necessary for the developer to maintain the average home
size being developed in the area. The applicant indicated
Lots 5 — 14 would contain a 20-foot permanent drainage
and a 15-foot permanent landscape easement across the
rear, while Lots 16 and 17 were subject to a 25-foot sewer
easement that cut across a portion of each lot's rear yard.
The applicant is now proposing a revision to the previously
approved preliminary plat for the Phase III portion of the
subdivision. The purpose of the revision is to subdivide
10.97 acres into forty-two (42) residential lots. The
following variances are being requested from the various
ordinance development standards:
1. A variance from Section 31-232(a) to allow a
reduced lot depth for Lots 1 — 16, 24 — 27 and
30.
2. A variance from Section 31-256 to allow a
reduced platted building line for Lots 1 — 42.

Stonecreek Village Subdivision
Dear Donna:
Submitted herewith are eighteen (18) copies of the preliminary plat and a preliminary plat
application for the above referenced subdivision. The purpose of this submittal is to subdivide
a 10.97 acre tract of residential zoned property into forty-two (42) single-family residential lots
Water and wastewater services will be provided by Central Arkansas Water and Little Rock
Wastewater Utility, respectively. A portion of the project was previously preliminary platted as
Glen Valley Subdivision. Stonecreek subdivision, adjacent to this project was final platted in
2005.
While lots 1, 10 and 30 meet the minimum lots footage, the buildable areas are suspect due to
their shape and setback requirements. A typical house sketch has been enclosed for each lot
to help demonstrate their development. Lots 1-7 are adjacent to an existing open earthen
drainage ditch that was constructed with the Stonecreek Subdivision. The relative narrowness
of the tract along with being adjacent to the existing ditch causes the request for a reduced
front and rear setbacks.
Approval is requested pursuant to Arkansas Law on City Planning, Act 186 of 1957, Acts of
Arkansas, and section 36 of the Little Rock Code of Ordinances. If you have any questions
concerning this submittal, please do not hesitate to call.

Submitted herewith are four (4) copies of the revised preliminary plat for the above referenced
subdivision. Also enclosed are the copies of the proofs of owner's notifications and the
executed affidavit of authority.
All of the items listed on the list of review comments have been addressed. We have
incorporated traffic "roundabout" at the intersection of Glen Valley and Highlander Drives. We
have renamed the street to the south to Stonecreek Court and are asking that the sidewalk
requirement for that street be waived and instead the sidewalk be constructed along
Highlander Drive. As stated in the subdivision committee meeting, we think the sidewalk
around Highlander will be more beneficial to the community rather than down the cul-de-sac of
Stonecreek. If you have any additional questions or comments, please do not hesitate to call.
