Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required gOrdinance Resolution Approval Information Report Submitted By Bruce Moore The applicant is proposing a replat of Lots 1 — 17 of the Stonecreek Addition. The proposal includes a variance from the Subdivision Ordinance to allow a reduction of the front building line on Lots 1 — 17 from 25-feet to 15-feet and reduce the rear yard setback of Lots 15 and 16 from 25-feet to 15-feet None. Staff recommends approval of the requested variance. The Planning Commission voted to recommend approval of the requested variance, as recommended by Staff, by a vote of 9 ayes, 0 noes and 2 absent. The Planning Commission reviewed the proposed variance request at its August 18, 2005 meeting. There were no registered objectors present. All abutting property owners and Westchester/Heatherbrae Neighborhood Association were notified of the public hearing. BACKGROUND On October 16, 2004, the Little Rock Planning Commission reviewed a request to subdivide 15.4 acres into 55 single-family lots. The proposal included the development of the lots with garden style patio homes. The lots would be developed in three phases with 23 lots in the first phase (a final plat was executed for this phase on May 25, 2005), 7 lots in the second phase and 25 lots in the third phase. The applicant has indicated the lots would be served by a series of residential streets (cul-de-saes) with no outlet being planned to Gooch Lane. The development included a portion of Heatherbrae Phase 3, which was previously reviewed and approved for a preliminary plat. The applicant proposed to revise the previously approved plat. The revision included a reduction of the on -site detention area. The applicant worked with the Corp of Engineers, to reduce the previously required detention area. The applicant is now proposing a replat of Lots 1 — 17 of the Stonecreek Addition. The area is within the previously approved and final platted Phase I. The purpose of the replat is to extend the side lot lines of Lots 5 —14 across the permanent drainage easement, reduce the front building line on Lots 1 — 17 from 25-feet to 15-feet and reduce the rear yard setback of Lots 15 and 16 from 25-feet to 15-feet. The applicant has indicated the reduced setbacks are necessary for the developer to maintain the average home size currently being developed in the area. The applicant has indicated Lots 5 — 14 contain a 20-foot permanent drainage and a 15-foot permanent landscape easement across the rear, while Lots 16 and 17 are subject to a 25- foot sewer easement that cuts across a portion of each lot's rear yard. The purpose of the submittal is to seek approval for replatting of Lots 3 —17 of Stonecreek Addition. The proposed replat will do the following: 1) extend the side lot lines of Lots 5 —14 across the permanent drainage easement, 2) reduce the front setback of Lots 3 —17 from 25' to 15 and 3) reduce the rear setback of Lots 15-17 from 25' to 15'. The developer is seeking these changes as to be able to maintain the average size home being built in the subdivision, but give each lot the maximum amount of rear yard as possible. As you can see from the plat, Lots 5 — 9 are subject to a 20' permanent drainage and a 15' permanent landscape easement across the rear, while Lots 8 —15 are subject to a 25' permanent drainage and a 15' permanent landscape easement across the rear. Also Lots 16 ; and 17 are subject to a 25' sewer easement that cuts across each lots rear yard. We do not think that having a 25' front setback on the east side and a 15' front setback on the west side will detract from the front presentation of the lots along Clancy Court. Approval is requested pursuant to Arkansas Law on City Planning, Act 185 of 1957, Acts of Arkansas, and Section 36 of the Little Code of Ordinances. A completed application form, information sheet, check for the filing fee and a copy of the previously recorded Bill of Assurance for Stonecreek Phase 1, has also been enclosed. The floor area of any one-story dwelling constructed on any lot or part thereof shall be not less than 2400 square feet and any two story not less than 2800 square feet. In all cases, the floor area shall be the finished, heated and cooled living area of the building within its largest outside framed dimensions, exclusive of open porches, decks, eaves, carports and garages, breezeways, terraces, and exterior or secondary stairways. 4. Building Location. No building or fences shall be constructed on lot nearer to the street than the building line shown on said plat; provided, retaining walls to the finished grade of a lot are permitted so long as they do not encroach onto easements or public rights -of way. No building shall be located nearer to an interior lot line than 10% of the average width of the lot, provided, however, such side yard need not exceed 8' in width. No main building shall be built on any interior lot in said addition nearer than 25 feet to the rear lot line. No detached structures other than a garage may be placed or constructed on a lot. The moving of any existing structure upon and to a lot is prohibited. Architectural Control. No building shall be erected, placed or altered on any property in this subdivision until the building plan, exterior materials, exterior color scheme, and plot plan showing the location and facing of such building with respect to existing topography, adjoining streets and finished ground elevations have been approved in writing by the Bosley Construction Inc. and it's Designee(s). Until further notice from Bosley Construction Inc. plans shall be submitted to Bosley Construction Inc. at 9107 Rodney Parham Road, Little Rock, Arkansas. In the event Bosley Construction Inc. and/or it's Designee(s) fails to approve or disprove any plans, exterior materials, exterior color scheme, or plot plan submitted to it, as herein required, within 30 days after such submission, this covenant shall be deemed to have been fully met by the person submitting such plans for approval. Easements. No building, fences, walls, incinerators, paved driveways, landscaping or any other permanent structure or improvement of any kind, whether herein specifically enumerated or not, shall be built or maintained within the area of any of the easements shown on the plat, and in the event any such obstruction is placed thereon in violation of this restriction and reservation, no utility will be liable for destruction of same in maintaining or repairing its facilities located within the area of said easement. 7. Signs. No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than one square foot, one sign of not more than five square feet advertising the property for sale or rent, or signs used by a builder, developer or realtor to advertise the property during the construction and sales period. Nuisances. No noxious or offensive activity shall be carried on upon any tract or lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. Livestock and Poultry. No animals, livestock, or poultry of any kind shall be raised or kept on any building site, except dogs, cats, or other household pets may be kept, provided they are not kept or maintained for commercial purposes. Page 3 of 5 10. Temporary Structures. No structure of a temporary character, trailer, basement, tent, shack, garage, barn, or other outbuildings shall be used on any lot at any time as a residence; either temporarily or permanently. 11. Sight distances at Intersections. No fence, wall, hedge, or shrub planting, which obstruct sight lines at elevations between two and six feet above the roadways, shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property lines and a line connecting them at points 50 feet from the intersection of the street lines; or in the case of a rounded property corner, within the triangle formed by tangents to the cure at its beginning and end, and a line connecting them at points 50 feet from their intersection. No tree shall be permitted to remain within such distance of such intersections unless the foliage line is maintained at a height of 8 feet to prevent obstructions of such sight lines. The same sight line -limitations shall apply on any lot within ten feet of the intersection of the street property line with the edge of a driveway or alley pavement. 12. Curbs and Gutters. No obstruction shall be placed in the street or gutter. Curbs shall be broken at driveways, and driveway aprons shall not extend past the face of the curb. 13. These covenants and restrictions are to run with the land and shall be binding on all parties and all persons claiming under them for a period of 30 years from the date of these covenants and restrictions shall be automatically extended for successive periods of 10 years, unless an instrument signed by a majority of the then owners of the lots has been recorded, agreeing to change of said covenants and restrictions in whole or in part. 14. These covenants and restrictions shall not be amended, canceled or supplemented unless an instrument signed by the owners of at least eighty (80) percent of the aforesaid lots is placed on record agreeing to change the covenants and restrictions in whole or in part and any change must be approved by the Little Rock Planning Commission. 15.
