HomeMy WebLinkAbout16695 1 RESOLUTION NO. 16,695 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 AMEND THE CONTRACT WITH BURKHALTER 5 TECHNOLOGIES, INC. IN AN AMOUNT NOT TO EXCEED FIFTY 6 THOUSAND DOLLARS, ($50,000.00), FOR ADDITIONAL 7 SIDEWALK AND ACCESS RAMP REPLACEMENT FOR "R" 8 STREET AND FILLMORE STREET DRAINAGE IMPROVEMENT 9 PROJECT; AND FOR OTHER PURPOSES. 10 11 WHEREAS,the City Board of Directors adopted Resolution No. 16,433(October 2,2024)to authorize 12 the City Manager to enter into a contract with Burkhalter Technologies, Inc., (the "Contract") for the R 13 Street and Fillmore Street Drainage Improvement Project in amount not to exceed Two Hundred Forty 14 Thousand, Seven Hundred Thirty-Two Dollars($240,732.00); and, 15 WHEREAS,the Contract for R Street and Fillmore Street Drainage was executed November 21,2024, 16 between the Acting City Manager for the City of Little Rock and Burkhalter Technologies, Inc.; and, 17 WHEREAS, after construction commenced, it has been determined that the resurfacing of Fillmore 18 Street as part of this project will necessitate a need to construct a concrete base, reconstruct additional 19 handicap access ramps and sidewalk,and related work. 20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 SECTION 1. The Board of Directors hereby authorizes the City Manager to execute an amendment 23 to the contract with Burkhalter Technologies, Inc. in an amount not to exceed Fifty Thousand Dollars 24 ($50,000.00), for a revised total contract not to exceed Two Hundred Ninety Thousand, Seven Hundred 25 Thirty-Two Dollars ($290,732.00) for construction of the R Street and Fillmore Street Drainage 26 improvement project. 27 SECTION 2. Funding for this project is from the 2022 Capital Improvement Bonds as authorized by 28 Little Rock,Ark., Resolution No. 15,968(May 3, 2023)with funds from Account Activity B3D028D. 29 SECTION 3. Severability. In the event any title,section,paragraph, item,sentence,clause,phrase,or 30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 33 resolution.
