PD !b Z-6813-A WARD 7 STAGE THEW ST SIDE OF STAGECOACH BASELINE ON NORTH ORDINANCE NO. 18,879 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED STAGECOACH COMMONS SHORT -FORM PCD (Z-6813-A) LOCATED ON STAGECOACH ROAD ONE-HALF MILE SOUTH OF BASELINE ROAD IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R-2 to PCD: Part of the NE '/4, Section 5, T-1-S, R-13-W, Little Rock, Pulaski County, Arkansas more particularly described as: Starting at the southwest corner of NE '/4 of said Section 5; tb.ence NO2°11'03"E along the west line of said NE 1/4, 703.08 feet, to a point on the east line of Lot 60, Westfield Subdivision, Little Rock, Arkansas; thence NO2°11'03"E and continuing along said west line, 643.32 feet to the point of beginning; thence NO3°50'10"E, 272.87 feet; thence along an existing wire fence the following: S70°52'54"E, 16.00 feet; S84°16'53"E, 89.00 feet; S84°11'51"E, 100 feet; S83°51'53"E, 100 feet; S84°02'50"E, 100 feet; S84°18'46"E, 100 feet; S84°39'51"E, 100 feet; S84°00'47"E, 100 feet; S84'01'40"E, 100 feet; S83°47"57"E, 100 feet and S83°22'48"E, 69.91 feet to a point on the west right-of-way line of Arkansas Stage Highway #5; thence along said west right-of-way line the following: S30°56'02"W, 224.17 feet; thence N88°24'37"W, 872.24 feet to the point of beginning containing 4.98 acres more or less. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Stagecoach Commons Short -form PCD is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION S. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. PASSED: June 3, 2003 ATTEST: City qerk APPROVED: t ORDINANCE NO. 18, 878 AN ORDINANCE GRANTING A VARIANCE FROM VARIOUS LOT DEVELOPMENT STANDARDS OF CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; PROVIDING FOR A VARIANCE TO ALLOW LOTS WITHOUT PUBLIC STREET FRONTAGE, FOR THE STAGECOACH COMMONS SUBDIVISION — PRELIMINARY PLAT (S-1383), LOCATED ON STAGECOACH ROAD ONE-HALF MILE SOUTH OF BASELINE ROAD, IN THE CITY OF LITTLE ROCK, ARKANSAS. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That a variance from various lot design standards of Chapter 31 of the Code of Ordinances is granted to provide for variances of certain requirements within the Subdivision Regulations of the City of Little Rock for Stagecoach Commons Subdivision — Preliminary Plat (S-1383) as follows: Subsection A. That variances are granted from the provisions of Chapter 31, Section 31-231 to allow Lot 2 of the Stagecoach Commons Subdivision to develop without public street frontage. SECTION 2. This ordinance shall take effect thirty (30) days from. and after its passage. PASSED: June 3, 2003 ATTEST: 11 z Cler APPROVED: Maya OFFICE OF THE CITY MANAGER LITTLE ROCK, ARKANSAS BOARD OF DIRECTORS COMMUNICATION JUNE 3, 2003 AGENDA Subject An Ordinance establishing variances from the Subdivision Ordinance for the Stagecoach Commons Subdivision (S-1383) located on Stagecoach Road 1/2 mile south of Baseline Road on the west side Action Required Ordinance Resolution Approval Information Report Submitted By Bruce Moore City Manager SYNOPSIS The applicant proposes to rezone the site R-2 to PCD and establish a two (2) lot plat. The plat will require a variance from the Subdivision Ordinance to allow a lot without public street frontage. The rezoning request is a separate item on this agenda (File No. Z-6813-A). FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested variance. The Planning Commission voted to recommend approval of the variance request, as recommended by Staff, by a vote of 10 ayes, 0 noes and I absent. CITIZEN The Planning Commission reviewed the proposed PCD PARTICIPATION request, including the lot variance, at its May 1, 2003 meeting. There were no objectors present. All property owners within 200 feet of the site, all residents within 300 feet who could be identified and the Otter Creek Property Owners Association, the Crystal Valley Neighborhood Association and Southwest Little Rock United for Progress were notified of the Public Hearing. BACKGROUND The applicant proposes to subdivide this site into two (2) non- residential lots. One of the proposed lots will be developed without public street frontage thus requiring a variance from the Subdivision Ordinance Section 31-231 to allow lots without public street frontage. A cross access easement will be provided for the rear lot to access to Stagecoach Road. To Staff s knowledge, there are no outstanding issues associated with the proposed development plan.
