VARIOUS LOT DEVELOPMENT STANDARDS OF
CHAPTER 31 OF THE CODE OF ORDINANCES OF THE
CITY OF LITTLE ROCK, ARKANSAS; PROVIDING
FOR A VARIANCE TO ALLOW A LOT WITHOUT
PUBLIC STREET FRONTAGE FOR FAMILY DOLLAR
ADDITION - PRELIMINARY PLAT (S-1365),
LOCATED AT 8510 ASHER AVENUE.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That a variance from various lot design
standards of Chapter 31 of the Code of Ordinances is
granted to provide for variances of certain requirements
within the Subdivision Regulations of the City of Little
Rock for Family Dollar Addition - Preliminary Plat (S-1365)
as follows:
Subsection A. That variances are granted from the
provision of Chapter 31, Section 31-231 to allow Lot 2 to
have no direct public street frontage.
SECTION 2. This ordinance shall take effect thirty
(30) days from and after its passage..

DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED FAMILY DOLLAR
STORE SHORT -FORM PCD (Z-7297) LOCATED AT
8510 ASHER AVENUE IN THE CITY OF LITTLE
ROCK, ARKANSAS, AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the
following described property be changed from C-3 and R-2 to
PCD:
Part of the NE 14 NW 14 Section 23; T-i-N, R-13-W,
Pulaski County, Arkansas, being more
particularly described as: Commencing at the NW
Corner NE ;,4 NW 16,4 thence S 8802412511E 756.41 feet

a right of way for Asher Avenue (State Highway
#5) along the South line, an ingress/egress
easement for a cell tower along the West line
and any easements that may be of record or
physically in place.
SECTION 2. That the preliminary site development
plan/plat be approved as recommended by the Little Rock
Planning Commission.
SECTION 3. That the change in zoning
classification contemplated. for Family Dollar Store Short -
form PCD is conditioned upon obtaining a final plan
approval within the time specified by Chapter 36, Article
VII, Section 3.6-454 (e) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36
of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to
affect and designate the change provided for in Section 1
hereof.
SECTION 5. That this Ordinance shall not take
effect and be in full force until the final approval of the
plan.
SECTION 6. Severability. In the event any title,
section, paragraph, item, sentence, clause, phrase, or word
of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall
not affect the remaining portions of the ordinance which
shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.
SECTION 7. Repealer. All laws, ordinances,
resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed
to the extent of such inconsistency.

SYNOPSIS
The applicant proposes to create a two lot plat. The
proposed plat will require a variance from the
Subdivision Ordinance; to allow a lot without public
street frontage.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the requested variance. The
Planning Commission voted to recommend approval of the
variance request, as recommended by Staff, by a vote of 9
ayes, 0 noes and 2 absent.
CITIZEN
The Planning Commission reviewed the proposed plat
PARTICIPATION
request at its October 31, 2002 meeting. There were no
objectors present. All property owners within 200 feet of
the site, all residents within 300 feet, who could be
identified, and the Westwood and the John Barrow
Neighborhood Associations and Southwest United for
Progress were notified of the Public Hearing.
BACKGROUND

The applicant proposes to rezone the site from C-3 and R-2
to PCD (File # Z-7297) to allow the construction of an
8000 square foot Family Dollar Store on the site along
with 27 parking spaces. In addition, the applicant
proposes a two lot plat as a part of the development, to
allow a portion of the site to be donated to the Optimist
BACKGROUND Club at a later date. The proposed plat will require a
CONTINUED variance to the Subdivision Ordinance; to allow a lot
without public street frontage.
Staff is "supportive of the requested variance to allow the
lot to be subdivided in this manner conditioned upon prior
to the lot developing as single-family the land area must be
recombined with other acreage that has street frontage.
Please see the attached Planning Commission minute
record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.
To Staff s knowledge, there are no outstanding issues
associated with the proposed development plan. The
proposed development should have no adverse impact on
the surrounding neighborhood if developed as proposed.
