and desire to replat part of said lot: same
NOW, THEREFORE, WITNESSETH:
That I , the said John Kincaid hereinafter termed Grantor,
has caused said tract of land to be surveyed by Paul White ,
registered land surveyor, and a plat thereof made which is
identified by the title: Lots I and 2, Kincaid Addition Little Rock,
ArkansaEi and the date _January, 2003 and by the
signature of the said surveyor and the said Grantor, and bears a
Certificate of Approval executed by the Little Rock Planning
Commission, and is on record in the office of the Circuit Clerk
and ex-officio Recorder of Pulaski Country, Arkansas, in Plat
Book C Page 9V and the Grantors do hereby make this Bill of
Assurance.
The maximum peak roof height of any structure to be erected, or
subsequently altered on the property shall not exceed the lesser
of, (i)-a distance of thirty (30) feet form the ground or first
floor of the structure to the peak of roof height, or (ii) a
peak roof elevation of 506 feet above sea level. A variance of
this covenant shall require Grantor's written approval. Grantor
shall incur no liability refusing to approve Grantee's request.
This restrictive covenant shall remain effective as long as John
C. and/or Debbie R. Kincaid own the residence located at 3401
Hill Road, Little Rock, Pulaski County, Arkansas.
The Grantors do hereby certify that they have replatted said
real estate in accordance with said plat. The lands embraced in
said plat shall be forever known as designated on said plat; and
every deed of conveyance for said property shall use this
designation and shall be subject to the as amended Bill of
Assurance file
of record at none recorded �
