APPROXIMATELY 500 FEET WEST OF STAGECOACH ROAD IN
THE CITY OF LITTLE ROCK, ARKANSAS.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS.
SECTION 1. That a variance from various lot design standards of
Chapter 31 of the Code of Ordinances is granted to provide for
variances of certain requirements within the Subdivision
Regulations of the City of Little Rock for Forest Gardens
Subdivision Preliminary Plat (S-1360) as follows:
Subsection A. That variances are granted from the provision
of Chapter 31, Section 31-256 to allow all lots to have a reduced
platted front building line of 5-feet on Lots 1R - 26R; and
Subsection B. That variances are granted from the provision
of Chapter 31, Section 31-232(b) to allow Lots 10R, I1R, 12R, 13R,
25R and 26R to be more than three times as deep as it is wide; and
Subsection C. That variances are granted from the provision
of Chapter 31, Section 31-232(a) to allow lots to have a reduced
minimum lot width on Lots 1R - 26R; and
Subsection D. That variances are granted from the provision
of Chapter 31, Section 31-231 to allow lots without public street
frontage for Lots 1R - 26R.
SECTION 2.This ordinance shall take effect thirty (30) days
from and after its passage.

PLANNED ZONING DISTRICT AND PROVIDING FOR
THE ESTABLISHMENT OF PLANNED RESIDENTIAL
DISTRICT TITLED FOREST GARDENS REVISED
LONG -FORM PD-R (Z-6948-A) LOCATED SOUTH
OF WEST BASELINE ROAD APPROXIMATELY 500
FEET WEST OF STAGECOACH ROAD IN THE CITY
OF LITTLE ROCK, ARKANSAS, AMENDING
ORDINANCE NO. 18,412 AND THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 18,412 passed on
January 16, 2001 be amended to provide for modification of
the Planned Zoning Development described as Forest Gardens
Revised Long -form PD-R (Z-6948-A).
SECTION 2. That the zoning classification of the
following described property be changed from PD-R to
Revised PD-R:
Part of the North Half of the Northeast Quarter
of Fractional Section 5, Township 1 South, Range
13 West Pulaski County, Arkansas described as
follows: Commencing at a point of intersection
of the north line of said HE 14 of Section 5 and
the centerline of Stagecoach Road and run thence
South 24°10154" West for 300.96 feet; thence
North 87'16133" West for 699.58 feet to a #6
rebar w/cap #212 said point being the point of
beginning of said property; thence South 1°12'34"
West for 348.71 feet to the north line of
property described in Pulaski County Deed Record
Book 79 at page 49511; thence North 87°07'47"
West along the north line of said property and
the north line of Stagecoach Village, Tract A,
Phase 1, to the City of Little Rock, Arkansas for
625.40 feet to a #4 rebar at the southeast corner
of property described in Pulaski County Deed
Record Book 86 at page 3472; thence North
1012134" East along the east line of said
property (Book 86 page 3472) for 348.14 feet to a
#6 rebar at the southwest corner of property
described in Pulaski County Deed Record Book 950
at page 435; thence South 86°54112" East along
the south line of said property (Book 950 page
435) for 352.85 feet to a 1 inch iron, pipe at the
southwest corner of property described in Pulaski
County Deed Record Book 95 at page 63091; thence
South 87032137" East along the south line of said
property (Book 95 page 63091) for 272.54 feet to
the point of beginning, containing 5.001 acres
more or less.
SECTION 3. That the preliminary site development
plan/plat be approved as recommended by the Little Rock
Planning Commission.
SECTION 4. That the change in zoning
classification contemplated for Forest Gardens Revised
Long --form PD--R is conditioned upon obtaining a final plan
approval within the time specified by Chapter 36, Article
VII, Section 36-454 (e) of the Code of Ordinances.
SECTION S. That the map referred to in Chapter 36
of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and it is hereby
amended to the extent and in the respects necessary to
affect and designate the change provided for in Section 2
hereof.
SECTION 6. That this Ordinance shall not take
effect and be in full force until the final approval of the
plan.
SECTION 7. Severability. In the event any title,
section, paragraph, item, sentence, clause, phrase, or word
of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall
not affect the remaining portions of the ordinance which
shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.

SECTION 8. Repealer. All laws, ordinances,
resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed
to the extent of such inconsistency.

The applicant proposes to revise a previously approved
Planned Development to create a revised preliminary
plat. The plat will require the following variances.
1. A variance to create lots with out public street
frontage.
2. A variance to from the lot depth to width ratio for Lots
10, 11, 12, 13, 25 and 26.
3. A variance to allow a reduced minimum lot width for
Lots 1 - 26.
4. A variance to allow a reduced front platted building
lines and reduced side yard setbacks on Lots 1 - 26.

Staff recommends approval of the proposed variances.
The Planning Commission voted to recommend approval
of the variance requests, as recommended by staff, with a
vote of 9 ayes, 0 nays and 2 absent.
The Planning Commission reviewed the proposed revised
preliminary plat request at its October 31, 2002 meeting.
There were no objectors present. All abutting property
owners and the Otter Creek Homeowners Association and
Southwest United for Progress were notified of the Public
Hearing.
BACKGROUND
The Board of Directors approved Ordinance No. 18,412 on
January 16, 2001 establishing Forest Gardens Long -form
PD-R. The applicant proposed a total of 19 buildings and
26 units (one lot), which would be developed under a
horizontal property regime. The applicant proposed the
maximum height of the structures not exceed to 32 feet and
that all units would have attached garages and/or carports
and a total of 45 parking spaces.
The applicant requested a two lot plat as a part of the
development. Lot 1 was adjacent to Stagecoach Road and
Lot 2 is the site currently being considered for the revision
to the Planned Residential Development. Lot 2 was
created as a non -conforming lot and the Board of Directors
approved the lot configuration, a lot without public street
frontage, at their January 16, 2001 meeting. The applicant
requested and was granted a five (5) year deferral of
sidewalk placement along Stagecoach Road for Lot 1 by
Ordinance No. 18,414 dated January 16, 2001.
The previous site design was based on an attempt to retain
the center portion of the heavily wooded site as a common
green space, with the larger mature hardwood trees to
remain as the main marketing amenity. To achieve this
goal the applicant proposed a perimeter access drive,
which would serve the rear of each unit. The applicant
noted the driveway design was to be constructed to
accommodate city garbage trucks and fire trucks, and that
the garbage collection would be coordinated with public
works.
The applicant is now requesting a revised preliminary plat
to allow the development to develop with 26 individual
lots. The request includes four variances from the
Subdivision Ordinance. The applicant is requesting a
variance to allow lots without public street frontage, a
variance from the lot width to depth ratio for Lots 10, 11,
12, 13, 25 and 26, a variance from the minimum lot width
requirement for all the lots and a reduced platted building
line on the front and side yard setbacks for all lots. The
lots will be identified with a "R" to avoid conflicting lot
numbers from the previously approved preliminary plat.
The development will be developed in two (2) phases.
Please -see the attached Planning Commission minute
record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.

CONTINUED
To staffs knowledge there are no outstanding issues
associated with this application. Staff feels that the
proposed use of the property is appropriate and should
have no adverse impact on the general area.
