RESTRICTIVE COVENANTS AND BILL OF ONCE
OF REGIONS SUBDIVISION TO CITY OF LITTLE ROCK,
PULASKI COUNTY, ARKANSAS
TO: The Public
WHEREAS, Starmax Properties, LP, a Texas limited partnership and Grant
Edward McKay, an individual resident of the state of Arkansas, (together hereinafter
referred to as "Developer") are the sole owners of Lot B Regions Subdivision to the City
of Little Rock, Pulaski County, Arkansas ("Lot B") and desire to replat said Lot B into
two lots in accordance with paragraph 6.2 of the Declaration, Plat, Restrictive Covenants
and Bill of Assurance of Regions Subdivision to City of Little Rock, Pulaski County,
Arkansas recorded as Instrument Number 2002183814 filed of record on October 4, 2002
in Plat Record Book G at page 497 (the "Bill of Assurance"). Sandra McKay, wife of
said Grant Edward McKay, is a party hereto solely for the purpose of waiving her rights
of dower and homestead.
NOW, THEREFORE, WITNESSETH:
Developer has caused said tract of land to be surveyed by Paul M. White,
Registered Land Surveyor ("Surveyor"), and a replat thereof made which is identified by
the title:
Plat of Lots B-1-R & B-2-R Regions Subdivision, An Addition To The City of
Little Rock, Arkansas Being A Replat Of Lot B, Regions Subdivision, Li r G, - -C r.,.
Arkansas dated December 2002 and bears the signature of the said d J�

Commission, and is on record in the office of the Circuit Clerk and ex-officio - c;

does hereby make this Amendment to the Bill of Assurance.
The Developer does not by recording of this Bill of Assurance dedicate any
easements, restrictions or dedicate any rights -of -way whatsoever, notwithstanding any
indications on the plat showing areas for right-of-way or for access and easement, and
none of such area so designated shall be used for ingress and egress by the public or by
any other utility service company or persons whomsoever unless the Developer shall by
written instrument recorded with the Pulaski County Circuit Clerk and Recorder's Office
grant such right or unless this Bill specifically grants such rights.
The Developer hereby dedicates forever those specific areas (the "Utility
Easements") consisting of the cross -hatched areas designated and described on the Plat as
"Utility Easement" for use by the public or quasi -public entities for electric, telephone,
gas and water utilities, and for sewer and drainage requirements.
The Developer hereby dedicates forever unto the owner of Lot B-1-R, its heirs,
successors and assigns ("Lot B-1-R Owner"), that specific area (the "Access Easement")
consisting of an area in Lot B-2-R which is shown as 25 feet wide cross -hatched area
designated and described on the Plat as the "Access Easement" forever for the private use
of the Lot B-1-R Owner for the ingress and egress by the Lot B-1-R Owner, its agents,
contractors, and customers. The rights and easements dedicated to the Lot B-1-R Owner
in the Access Easement shall run with the land for the use and benefit of the Lot B-1-R

Developer does hereby certify that Developer has replatted said real estate in
accordance with said plat. The lands embraced in said replat shall be forever known as
designated on said replat; and every deed of conveyance for said property shall use this
designation and shall be subject to the Bill of Assurance. All references to Lot B in the
Bill of Assurance are amended by this Amendment to refer to Lots B-1-R and B-2-R.
EXECUTED on this 2-y day of December, 2002.

TO: The Public
WHEREAS, Starmax Properties, LP, a Texas limited partnership and Grant
Edward McKay, an individual resident of the state of Arkansas, (together hereinafter
referred to as "Developer") are the sole owners of Lot B Regions Subdivision to the City
of Little Rock, Pulaski County, Arkansas ("Lot B") and desire to replat said Lot B into
two lots in accordance with paragraph 6.2 of the Declaration, Plat, Restrictive Covenants
and Bill of Assurance of Regions Subdivision to City of Little Rock, Pulaski County,
Arkansas recorded as Instrument Number 2002183814 filed of record on October 4, 2002
in Plat Record Book G at page 497 (the "Bill of Assurance"). Sandra McKay, wife of

The Developer does not by recording of this Bill of Assurance dedicate any
easements, restrictions or dedicate any rights -of -way whatsoever, notwithstanding any
