BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS'. SECTION 1. That a variance from various lot design standards of Chapter 31 of the Code of Ordinances is granted to provide for variances of certain requirements within the Subdivision Regulations of the City of Little Rock for Ma=aart Addition - Preliminary Plat (S-1350-B) as follows: Subsection A. That variances are granted from the provision of Chapter 31, Section 31-231 to allow Lot 2 and Lot 3 to have no direct public street frontage. SECTION 2. This ordinance shall take effect thirty (30) days from and after its passage. That Ordinance No. 16,586 passed on February 1, 1994 and Ordinance No. 16,754 passed on October 4, 1994 and Ordinance No. 11,622 passed on December 2, 1997 and Ordinance No. 18,719 passed July 16, 20'02 be amended to provide for modification of the Planned Zoning Development described as Maxmart Revised Short -form PD-O (Z-5770-C). SECTION 2. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and Is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 2 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the.event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION S. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. The preliminary plat requires a variance from the Subdivision Ordinance to allow the creation of lots without pubic street frontage. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the proposed variance. The Planning Commission voted to recommend approval of the variance request, as recommended by staff, with a vote of 9 ayes, 0 nay and 2 absent. CITIZEN The Planning Commission reviewed the proposed planned PARTICIPATION development and the revision to the preliminary plat request at its October 31, 2002 meeting. There were no objectors present. All property owners within 200 feet of the site, all residents within 300 feet, who could be identified, and the Westchester/Heatherbrae Property Owners Association and the Walton Heights/Candlewood Neighborhood Association were notified of the Public Hearing. BACKGROUND On July 16, 2002, the Board of Directors approved a revision to the previously approved PD-O (Ordinance 418,719) to create a two (2) lot plat and allow the construction of a bank with a four (4) window drive - through facility on the front lot, adjacent to Cantrell Road, and the development of an office building on the rear lot. The applicant proposed a single access point to the site from Cantrell Road and a 30-foot cross access/utility easement to serve Lot 2. The applicant now proposes to revise a previously approved PD-O to allow the rear lot to be split. The rear lots will each contain approximately 12,000 square feet and are proposed as Lots 2 and 3. (Lot 1 has been final platted for Regions Bank.) The applicant proposes two office buildings, one on each lot, and the square footages to be 4300 (Lot 2) and 2800 (Lot 3) square feet with a shared parking and common drive access easement extending from Cantrell Road through Lot 1 to serve Lots 2 and 3. The sign area for Lots 2 and 3 is to be a maximum of five (5) feet in height and fifty (50) square feet in area. The applicant is requesting a variance from the Subdivision Ordinance to allow Lots 2 and 3 to not have public street frontage. A portion of the common access drive/utility easement has been final platted with Lot 1 and the remainder will be final platted to provide access to Lots 2 and 3 upon final platting of these lots. Please see the attached Planning Commission minute record and site plan for the applicant's specific development proposal and the staff analysis and recommendation. To staff s knowledge there are no outstanding issues associated with this application. Staff feels that the proposed use of the property is appropriate and should have no adverse impact on the general area. ORDINANCE NO.
