CHAPTER 31 OF THE CODE OF ORDINANCES OF THE
CITY OF LITTLE ROCK, ARKANSAS; PROVIDING
FOR A VARIANCE TO ALLOW A LOT WITHOUT
PUBLIC • STREET FRONTAGE FOR MAX MART
ADDITION - PRELIMINARY PLAT (S-1350),
LOCATED NORTH OF CANTRELL ROAD
APPROXIMATELY 8,700 FEET EAST OF RUMMELL
ROAD.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That a variance from various lot design
standards of Chapter 31 of the Code of Ordinances is
granted to provide for variances of certain requirements
within the Subdivision Regulations of the City of Little
Rock for Max Mart Addition - Preliminary Plat (S-1350) as
follows:
Subsection a. That variances are granted from
the provision of Chapter 31, Section 31-231 to
allow Lot 2 to have no direct public street
frontage.
SECTION 2. This ordinance shall take effect thirty
(30) days from and after its passage.

DEVELOPMENT AND ESTABLISHING A PLANNED
OFFICE DISTRICT TITLED MAX MART SHORT -
FORM POD (Z75770-B) LOCATED NORTH OF
CANTRELL ROAD APPROXIMATELY 800 FEET EAST
OF RUMMELL ROAD IN THE CITY OF LITTLE
ROCK, •ARKANSAS, AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the
following described property be changed from PD-O to POD:
Part of the fractional NW '-4 of Section 19, T-2-N,
R-13-W, Pulaski County, Arkansas more
particularly described as: Beginning at the
Northwest corner of the NE 3a NW '� said Section
19; Thence S87°53'00E, 164.76 feet; Thence
S87`51101"E, 88.73 feet; Thence S01°36'22"W,
501.40 feet to a point on the North Right -of -Way
Line of Arkansas State Highway #10; Thence
N67°02113"W, along said North Right -of -Way Line,
94.30 feet; Thence N61'38154"W, continuing along
said North Right -of -Way line, 7.13 feet; Thence
N01°28'43"E, 376.22 feet; Thence S88°11'55"E,
22.88 feet to the Point of Beginning, containing
2.7967 acres more or less.
SECTION 2. That the preliminary site development
plan/plat be approved as recommended by the Little Rock
Planning Commission.
SECTION 3. That the change in zoning
classification contemplated for Max Mart Short -form POD is
conditioned upon obtaining a final plan approval within the
time specified by Chapter 36, Article VII, Section 36-454
(e) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36
of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and it is hereby
amended to the extent and in the respects necessary to
affect and designate the change provided for in Section 1
hereof.
SECTION 5. That this Ordinance shall not take
effect and be in full force until the final approval of the
plan.
SECTION 6. Severability. In the event any title,
section, paragraph, item, sentence, clause, phrase, or word
of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall
not affect the remaining portions of the ordinance which
shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.
SECTION 7. Repealer. All laws, ordinances,
resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed
to the extent of such inconsistency.

SYNOPSIS
The applicant proposes a two -lot preliminary plat
(Max Mart Addition Preliminary Plat - S-1350) as a
component of the POD application Max Mart Short -
form POD (Z-5770-B). The preliminary plat requires
a variance for creation of a lot without pubic street
frontage.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the proposed variance. The
Planning Commission voted to recommend approval of the
variance request, as recommended by staff, with a vote of
8 ayes, 0 nay, 2 absent and 1 vacant position.
CITIZEN
The Planning Commission reviewed the proposed plat
PARTICIPATION
request at its June 20, 2002 meeting. There were no
objectors present. All property owners within 200 feet of
the site, all residents within 300 feet who could be
identified, and the Westchester/Heatherbrae, the Westbury
and Secluded Hills Neighborhood Associations were
notified of the Public Hearing.
BACKGROUND
The applicant is proposing to subdivide this parcel of
property into two non-residential lots to be used as office
uses and develop the site with two buildings. A variance
from the Subdivision Ordinance is required for the parcel
to be subdivided, (a lot without public street frontage).

CONTINUED
The development will contain a single access point to the
site from Cantrell Road. The applicant has agreed to allow
a cross access easement with the property owner to the east
as requested by Public Works Staff.
Please see the attached Planning Commission minute
record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.
To staff s knowledge there are no outstanding issues
associated with this application. Staff feels that the
proposed use of the property is appropriate and should
have no adverse impact on the general area.
