TO THE PUBLIC Know All Men By These Presents: J�� 7 73S That Woodlands Edge Community Association, Inc., hereinafter called the Association, and Rocket Properties, LLC, hereinafter called the Developer, are the owners of the following property: TRACTS R-Al and R-A2 Woodlands Edge, An addition to the City of Little Rock, Pulaski County, Arkansas WHEREAS, on the 24th day of May, 2006, Rocket Properties, LLC, the developer, filed a Plat and Bill of Assurance creating Tract R-A WOODLANDS EDGE which is fled of record in the Office oNh-e-gircuit Clerk and Recorder for Pulaski County, Arkansas in Plat Book H733 and Instrument Number 2 WHEREAS, on the 5`h day of June, 2006, Rocket Vrb �ies, t.LC, the developer, filed a Quitclaim Deed conveying Tract R-A, Woodlands Edge, to the Woodlands-��rminunity Association, Inc., which is filed of record in the Office of the Circuit Clerk and Recorder for Pulaski County, Arkansas as Instrument Number 2006042963; and, WHEREAS, the aforementioned property is part of the real property which is subject to a Declaration of Covenants and Restrictions filed on the 28th day of August, 2002, in the Office of the Circuit Clerk and Recorder of Pulaski County, Arkansas, as Instrument No. 2002172411 ("The Declaration of Covenants and Restrictions"), and an Addendum to Covenants and Restrictions filed on the 6th day of June, 2003 as Instrument No. 2003054586 which establishes a community with common facilities and amenities known as WOODLANDS EDGE; and, WHEREAS, it is deemed desirable to restate and make specific amendments to said Plat Prepared by: H. Baker Kurrus, Attorney At Law Ark. Bar Assn. #80082 P.O. Box 3157, Little Rock, AR 72203 (501)835-2878 and Bill of Assurance, and that the above described property be replatted into two tracts as shown on the Plat filed in conjunction with this Amended and Restated Bill of Assurance; and, WHEREAS, this Plat and Bill of Assurance are re -recorded to adjust the North line of Tract R-A2; and, NOW THEREFORE, Woodlands Edge Community Association, Inc. has caused the property to be surveyed by White-Daters & Associates, Inc., Registered Land Surveyors, and a Plat thereof made which is identified by the title WOODLANDS EDGE, Tracts R-Al and R- A2 and the date April 23, 2008, and said Plat bears the signature of the said Land Surveyor and the said Association, and is of record in the Office of the Circuit Clerk and Recorder for Pulaski County, Arkansas, in Plat Book 2008027731, and the Association does hereby make this Amended and Restated Plat and Bill of Assurance applicable to such property. 1. PROPERTY SUBJECT TO DECLARATIONS. Rocket Properties, LLC, as the owner of Parcel 1, hereby declares that Parcel 1 is subject to the Declaration of Covenants and Restrictions as amended. Both Tracts R-Al and R-A2 are hereby subject to the Declaration of Covenants and Restrictions as amended. 2. TRACT R-Al. All restrictions contained in the Declaration of Covenants and Restrictions as amended, and in the Plat and Bill of Assurance for R-A shall apply to R-Al and shall remain in full force and effect. 3. TRACT R-A2. Said land herein platted as R-A2 shall be held, owned and used only for green spaces, greenbelts, natural buffers, open spaces, picnic areas, trails, sidewalks, walkways, driveways, and landscaped areas. No structure shall be erected, altered, placed, or permitted to remain on such land, other than an open air pavilion which has been approved in writing by the Woodlands Edge Community Association, Inc. Architectural Control Committee. No part of this property shall be subdivided without the written consent of the Association and the Little Rock Planning Commission first had and obtained. 4. PROPERTY LINES AND BOUNDARIES. Iron pins have been set on all corners and points of curve, and all curve data shown on said Plat referenced herein is centerline curve data. In the event of minor discrepancies between the dimensions or distances shown on the Plat and the actual dimensions or distances as disclosed by the established pins, the original pins as set shall control. 5. ENFORCEMENT. In the event of any attempt to violate any of the covenants or restrictions contained herein, it shall be lawful for Woodlands Edge Community Association, Inc., any appropriate governmental authority, the Developer, or any person or persons owning a lot or lots in WOODLANDS EDGE to initiate compliance procedures pursuant to the terms of The Declaration of Covenants and Restrictions, or to pursue any other lawful remedy. 6. AMENDMENT. This Bill of Assurance may be cancelled, amended or extended in accordance with the terms set forth in The Declaration of Covenants and Restrictions. No amendment shall be effective unless and until duly enacted pursuant to the terms of The Declaration M of Covenants and Restrictions and properly filed for record in the Office of the Circuit Clerk and Recorder for Pulaski County, Arkansas. 7. SEVERABILITY. The invalidation of any one of these covenants or restrictions by any court of competent jurisdiction or otherwise shall in no way affect any of the other provisions, which shall be independent and which shall remain in full force and effect. All buildings constructed on said Tract shall be constructed no nearer to the street than the building line shown on the plat, and all building shall be constructed in conformance with the building code and zoning ordinance of the City of Little Rock, Arkansas. 2. NO ACCESS EASEMENT. A ten foot (10') wide "No Access Easement" is located along the right-of-way of Woodlands Trail. The purpose of said "No Access Easement" is to prohibit vehicular access across the "No Access Easement". Access may not be taken and no motorized vehicles of any type may cross said Easement except as approved by the Developer for maintenance, construction and other purposes. 3.
