3 AN ORDINANCE TO AMEND SECTION 1 OF LITTLE ROCK,
4 ARK. ORDINANCE NO. 18,615 (DECEMBER 18, 2001)
5 CONCERNING FRANCHISE FEES TO BE PAID TO THE CITY OF
6 LITTLE ROCK, ARKANSAS BY THE LITTLE ROCK WATER
7 RECLAMATION AUTHORITY;AND FOR OTHER PURPOSES.

9 WHEREAS,the City passed Little Rock,Ark.Ordinance No. 18,615(December 18,2001)that granted
10 a franchise to the Little Rock Water Reclamation Authority (formerly the Little Rock Sanitary Sewer
11 Committee) for the use of the City's rights-of-way and set a franchise fee therefor equal to five percent
12 (5%)of the gross revenues of the Little Rock Water Reclamation Authority; and,
13 WHEREAS, the City proposes to amend Ordinance No. 18,615 to exclude certain revenues of Little
14 Rock Water Reclamation Authority from the franchise fee calculation.
15 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 Section 1. Section 1(A)of the Ordinance No. 18,615 is hereby amended to read as follows:

19 The Little Rock Water Reclamation Authority,for the use and enjoyment of City rights-
20 of-way,to provide sanitary sewer utility services within the corporate limits of the City of
21 Little Rock,Arkansas,or in such extraterritorial areas that have been approved by the City
22 Directors, shall be responsible for a franchise fee payment to the City on a monthly basis
23 that is equal to five percent (5%) of the gross revenues of the Little Rock Water
24 Reclamation Authority. For purposes of such calculation,gross revenues shall not include
25 revenues from any user with an installed and billed meter with discharge exceeding
26 750,000 gallons per day on an annual average;provided the City has contractually accepted
27 an alternate consideration for the Little Rock Water Reclamation Authority's use of its
28 rights-of-way for an eligible user.

30 Section 2. Ordinance No. 18,615 is hereby amended by replacing the "Little Rock Sanitary Sewer
31 Committee" with "Little Rock Water Reclamation Authority" in all places.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
2 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally part of the
3 ordinance.
4 Section 4. Repealer. All ordinances and parts of ordinances that conflict herewith are hereby
5 repealed; provided, however, only to the extent that the same are in direct conflict herewith. Except as
6 herein provided, nothing herein shall be construed to alter or change the terms or conditions of the present
7 franchise under which the Little Rock Water Reclamation Authority is operating as set forth in Ordinance
8 No. 18,615.
