Developer caused to be filed in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas that certain Bill of Assurance of Chenal Valley Commercial Neighborhood on September 30, 1996 as Instrument No. 96-68199 (the "Original Bill of Assurance") creating the Chenal Valley Commercial Neighborhood, a First Supplemental Bill of Assurance on February 19, 1997 as Instrument No. 97-10852, a Second Supplemental Bill of Assurance on November 7, 1997 as Instrument No. 97-074244, a Third Supplemental Bill of Assurance on September 24, 1998 as Instrument No. 98-074071, a Fourth Supplemental Bill of Assurance on December 22, 1998 as Instrument No. 98-101872, a Fifth Supplemental Bill of Assurance on December 31, 1998 as Instrument No. 98-103569, a Sixth Supplemental Bill of Assurance on April 1. 1999, as Instrument No. 99-026667, a Sixth Supplemental Bill of Assurance on August 20, 1999 as Instrument No. 99067159, a Seventh Supplemental Bill of Assurance on August 20, 1999 as Instrument No. 99067160, an Eighth Supplemental Bill of Assurance on March 31, 2000 as Instrument No. 2000021493, a Corrected Eighth Supplemental Bill of Assurance on 0 a. 3/ , 2000 as Instrument No 20000-7734, and a Ninth Supplemental Bill of Assurance on G , 3/ , 2000 as Instrument No.ZV4--V'77S10, (':\„ inJows\'fl itt11'\even- I Ongybua.nl I .,, pJ Ile 0lop idw WI iEREAS, Paragraph i of the Original Bill of Assurance provides that the Developer has the right to bring within the Plan of the Original Bill of Assurance additional properties provided such additions are in accord with the general plan of development; and WHEREAS, Developer hereby declares that the property described on Exhibit A attached hereto ("Unplatted Property") and made a part hereof, shall be held, transferred, sold, conveyed and occupied subject to the covenants, restrictions, easements, charges and liens set forth in the Original Bill of Assurance, and all amendments thereto, and such property herein described on Exhibit A shall be forever known as Chenal Valley GMAC Center; and Wl iFIZFIAS, the previously described Unplatted Properly is being platted as hots A and 13, Tract 13, Chenal Valley GMAC Center, an Addition to the City of Little Rock, Pulaski County, Arkansas; and WHEREAS, Developer files this Tenth Supplemental Bill of Assurance to reflect the new legal description to the Unplatted Property as Lots A and B, Tract 13, Chenal Valley GMAC Center, an Addition to the City of Little Rock, Pulaski County, Arkansas. NOW, THEREFORE, Developer, for and in consideration of the benefits to accrue to it, its Successors and Assigns, which benefits it acknowledges to be of value, has caused to be made a Plat, showing a survey made by Paul M. White, Registered Land Surveyor dated2�.3/ 2000 ,and bearing a Certificate of Approval executed by the Department of Comprehensive Planning of the City of Little Rock, Arkansas, and showing the boundaries and dimensions of the Real Property now being divided into Lots (the "Plat") Developer hereby donates and dedicates to the public an easement of way on, over and under the streets ("La Grande Drive") on said Plat to be used as public streets. In addition to the said c:\Whodowsrremir\cvcn-IOsup.boe.ix11.Hpd 2 streets, there are shown on said flat certain Casements for drainage and/or utilities which Developer hereby donates and dedicates to and for the use ol'public utilities, the same being, without limiting the generality of the foregoing, electric power, gas, telephone, water, sewer and cable television with the right hereby granted to the persons, firms or corporations engaged in the supplying of such utilities to use and occupy such easements, and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. There is shown on said Plat within the boundaries of Lots A and B, Tract 13, Chenal Valley GMAC Center, an Addition to the City of Little Rock, Pulaski County, Arkansas a Landscape Buffer. No owner of the described lots, their successors or assigns, may construct any improvements, structures, buildings, towers or walls within the Landscape Buffer, or modify by grading or otherwise (lie existing contour ol'the Landscape Buller without the prior written consent of the Chenal Valley Commercial Properly Owners Association, Inc. This restriction shall run with the land. The Lots subject to the Landscape Buffer shall be held, owned and conveyed subject to and in conformity with the restriction. The filing of this Tenth Supplement to the Bill of Assurance of Chenal Valley Commercial Neighborhood and Plat for record in the Office of Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall be a valid and complete delivery and dedication of the streets and drainage and/or utility easements subject to the limitations herein set out.
