HomeMy WebLinkAboutS-1293 Application,UaIts i..ra 2000090668 d�d�a 1212312UO�i 10:12:52 AM +c Filed d Recorded ip �'•� '� Official Records of CARDLYN STALEY PULASKI COUNTY � 0j CIRCUIT/COUNTY CLERk I 1 a Fees $22.00 To: The Public R .4131L, , OF ASSURANCE AND PLAT -Homes at•GLOanite Mountain WHEREAS, the Housing Authority of the City of Little Rock, Arkansas (the "Authority"), is the sole owner of the real property situated in Little Rock, Pulaski County, Arkansas and described on Exhibit A attached hereto and made a part hereof (the "Land"); WHEREAS, the Land consists of two parcels, one of which has earlier been platted, and one which has not, and the Authority deems it desirable that the Land be replatted and subdivided into new lots and tracts; NOW, THEREFORE, in consideration of the foregoing, and for other good and valuable consideration which the Authority acknowledges to be of benefit to it and sufficient: Grantor has caused the Land to be surveyed by Delbert Vanlandingham, Registered Professional Engineer, and a Final Plat thereof made identified by the title "Homes at Granite Mountain," dated December 18, 2000 signed by the engineer and the Authority, bearing a Certificate of Approval executed by the Little Rock Planning Commission, and recorded in the Office of the Circuit Clerk and Ex-officio Recorder for Pulaski County, Arkansas, in Plat Book -, Pageq15 (the "Plat") and the Authority does hereby make this Bill of Assurance and subject the Land to the terms hereof, which shall run with the Land. The Authority does hereby certify that it has replatted the Land in accordance with the Plat. The Land embraced in the Plat shall be forever known by the lot or tract number or letter designated on the Plat, with a reference to "Homes at Granite Mountain, an Addition of Little Rock, Pulaski County, Arkansas." In any and every deed of conveyance for any lot or tract shown on the Plat, describing the same by the lot or tract number or letter and a reference to "Homes at Granite Mountain, an Addition of Little Rock, Pulaski County, Arkansas," or words substantially to that effect, shall always be deemed a sufficient and complete description thereof. There are shown on the Plat certain easements for access, including a right of way for Granite Mountain Road and certain "service easements," together with easements and dedications for drainage and utilities, including electric power, gas, telephone, cable, water and sewer (collectively, as to access, drainage and utilities, the "Easements"); The filing of this Bill of Assurance and Plat for record in the Office of the Circuit Clerk and Ex-officio Recorder for Pulaski County, Arkansas shall be a valid and complete delivery and dedication to the public of the right of way for Granite Mountain Road, and the other Easements shown on the Plat. The Authority hereby donates and dedicates the Easements to, and for the use by and benefit of, public utilities, with the right hereby granted to the persons, firms or corporations engaged in the supplying of such utility services to use and occupy such Easements and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. This dedication shall be perpetual, unless and until the City of Little Rock, Arkansas, hereafter vacates and abandons such Easements in accordance with Arkansas law and ordinances of the City of Little Rock, Arkansas. All former boundary lines, set back lines, easements, covenants, restrictions, encumbrances, charges, assessments, liens and other terms, provisions and conditions made a part of the Bill of Assurance filed of record in Deed Book 923 at Page 265, and the plat filed in connection therewith, for Acme Addition (Plots A and D of which now comprise Lot 1, Homes at Granite Mountain), are hereby abandoned and removed from the Land (but not the remainder of Acme Addition) by virtue of the recording of this Bill of Assurance and Plat, and no further reference to Acme Addition shall be necessary or proper when describing any part of Homes at Granite Mountain. All buildings to be constructed on the Land shall be constructed no nearer to the rights -of -way than the building line(s) shown on the Plat; and all buildings shall be constructed in conformance with the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.
