HomeMy WebLinkAboutS-1284 ApplicationORDINANCE NO. 18,285 AN ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS PROVIDING FOR A WAIVER OF ALL SUBDIVISION ORDINANCE REQUIREMENTS FOR ST. THERESA'S CATHOLIC CHURCH/CAPTAIN D'S AT 6205 BASELINE ROAD AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 31 of the Code of Ordinances be amended to provide for a waiver of all requirements within the Subdivision Regulations of the City of Little Rock for St. Theresa's Catholic Church and Captain D's Restaurant (S.H.N. Properties, LLC) located at 6205 Baseline Road, lying within the NE 'ka, NE '�4 Section 1, T-1-S, R-13-W, more particularly described as: Start at a point which is the NE corner of the NE U4, Section 1, T-1-S, R-13-W; thence South to a point on the south right-of-way line of Baseline Road; thence run N88005'51" West along the said right-of-way line 670.79 feet to the point of beginning. Thence run S02°27133" West 193.58 feet to a point; thence S02°29101" West 400.15 feet to a point which is the SE corner of the East 1-z, East '�, NW k, NE ;a, NE ;a Section 1, T-1-S, R-13-W; thence N87052137" West for a distance of 167.31± feet; thence N02007144" East 593.7 feet to a point on the South right-of-way line of Baseline Road; thence S87055127" East 167.6± feet to the point of beginning. Subsection a. That Chapter 31., be amended to provide that the parcels of land at the described location be henceforth recognized as lots of record for purposes of future land sale or development. SECTION 2. This Ordinance shall take effect thirty (30) days from and after its passage. Action Required 4Ordinance Resolution Approval Information Report Cy Carney City Manager SYNOPSIS This request derives from Planning Staff and Planning Commission review of a C.U.P. for the church where a parcel of land was acquired by the church out of a lot occupied by a restaurant at 6205 Baseline Road. The Commission feels there is little to gain from a requirement to plat this small parcel of land. FISCAL IMPACT None, public infrastructure is in place. RECOMMENDATION The staff recommends approval as filed. The Planning Commission recommends approval as filed by a vote of 8 ayes, 0 noes, 2 absent and 1 open position. CITIZEN The neighborhood residents on the south abutting line were PARTICIPATION notified by 200 foot certified mail. The association was also notified of the conditional use permit issue hearing in which this matter was included. BACKGROUND The S.H.N., L.L.C. properties/Shoneys/sold by metes and bounds a portion out of the rear yard of the restaurant at 6205 Baseline thereby violating the Subdivision Ordinance basic rule of development. That is, transfer of less than five acres of land area without Planning Commission review. ORDINANCE NO. In the process the Delaware corporation did not subdivide their property in accordance with Little Rock ordinances prior to sale. The selling company is out-of-state and has no incentive to plat or subdivide the property now. We have worked extensively with the City planning staff to resolve all the issues of ownership, zoning and conditional use permit. They have been very helpful but this requires your assistance. Therefore we request your approval of a waver of the platting ordinance for the land to be used by the church as a parish center.
