WHEREAS, Steve and Missy Wortman are the sole owners of Lot 34 of Phase IV Valley
Falls Estates in Little Rock, Pulaski County, Arkansas (minus approximately 4,574 square feet of
the east side of Lot 34 which has been conveyed to Kenneth C. Hamilton);
WHEREAS, Kenneth C. Hamilton is the sole owner of Lot 35 Phase IV-B Valley Falls
Estates in Little Rock, Pulaski County, Arkansas;
WHEREAS, Steve and Missy Wortman have conveyed a portion of Lot 34 (a strip of
land on the east side of Lot 34 consisting of approximately 4,574 square feet) to Kenneth C.
Hamilton, resulting in a new boundary line between the two lots;
WHEREAS, a copy of the legal description for the portion of Lot 34 that has been
conveyed by Steve and Missy Wortman to Kenneth C. Hamilton is attached hereto as Exhibit
"A;1�
WHEREAS, the Warranty Deed wherein Steve and Missy Wortman conveyed the
aforementioned portion of Lot 34 to Kenneth C. Hamilton is recorded as Instrument Number
in the Pulaski County records;
WHEREAS, Steve and Missy Wortman and Kenneth C. Hamilton desire to re -plat said
lots in order to relocate the boundary line between the lots.
NOW, THEREFORE, WITNESSETH:
That we, the said Steve and Missy Wortman and Kenneth C. Hamilton, have caused the
aforementioned lots to be surveyed by Jonathan B. Hamner, PS 1524, a Registered Professional
Surveyor, and a plat thereof made which is indentified by title as Replat Survey — Lot 34R, Phase
IV and Lot 35R, Phase IV-B, A Replat of Lot 34, Phase IV and Lot 35, Phase IV-B, Valley Falls
Estates and the date April 26, 2012 and by the signature of said surveyor and Steve and Missy
Wortman and Kenneth C. Hamilton, and bears a Certificate of Approval executed by the Little
Rock Planning Commission, and is on record in the office of the Circuit Clerk and ex-officio in
Plat Book , Page (or as Instrument No. ao i ao 3 z1 g I ) and Steve and
Missy Wortman and Kenneth C. Hamilton do hereby make this Bill of Assurance.
Steve and Missy Wortman and Kenneth C. Hamilton do hereby certify that they have re -
platted the aforementioned lots in accordance with said plat. The lands embraced in said plat
shall be forever known as designed on said plat; and every deed of conveyance for said property
shall use this designation and shall be subject to the covenants, conditions, reservations and
restrictions contained in the Declaration of Restrictive Covenants and Bill of Assurance filed for

record and recorded as Instrument Number 2002167179 (for Lot 34; now Lot 34R) and the
Declaration of Restrictive Covenants and Bill of Assurance filed for record and recorded as
Instrument Number 2005101796 (for Lot 35; now Lot 35R) in the records of Pulaski County,
Arkansas.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit Court
Clerk and ex-officio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of the streets and easements shown on the said plat.
All buildings constructed on said lots shall be constructed no nearer to the street than the
building line shown on the plat, and all buildings shall be constructed in conformance with the
Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.
