NAME: Kenwood Subdivision Revised Preliminary Plat
LOCATION: located on David O Dodd Road, just South of JA Fair High School
Planning Staff Comments:
1. Provide notification of the abutting property owners including the certified abstract
list, notice form with affidavit executed and proof of mailing. The notice must be
mailed no later than June 11, 2014. The Office of Planning and Development must
receive the proof of notice no later than June 20, 2014.
2. The developer must secure all approvals from the various utility companies prior to
final platting of any remaining lots.
3. There are 89 lots remaining which have not been final platted. What 20 lots are
being requested to final plat prior to the street construction?
4. The cover letter indicates the final platting will be in phases. How are the final four
(4) phases proposed for final platting.
5. The request in 2006 allowed the increase in the number of lots to 220.
6. Correct the number of lots within the general notes section of the preliminary plat.
Variance/Waivers: A deferral of the boundary street ordinance requirements to
David O Dodd until the development of a later phase
Public Works Conditions:
The Kenwood Subdivision developer has known of the required boundary street
improvements to David O Dodd Rd since the subdivision was preliminarily platted in
1999. Staff supported a phased construction plan to David O Dodd Rd into three (3)
equal phases. The phases are: 1.) JA Fair School to subdivision entrance; 2.)
subdivision entrance to curve; and 3.) curve to east property line. Boundary street
improvements have been completed from JA Fair School to the curve. All infrastructure
and improvements have been completed for Phases I, II, III, VII, VIII and IX and these
phases have been final platted. Phases IV, V and VI have not been final platted. To
date the developer has platted 131 lots and 89 lots are remaining to be platted.
Per Ordinance No. 19,527 dated May 2, 2006, boundary street improvements from the
curve to the east property line were deferred for five (5) years or platting of Phase 6 of
the subdivision. Recently, the Master Street Plan street design standard for David O
Dodd Road has been reduced from 59 feet to 48 feet wide at the request of this
developer. The developer has known of the required improvements since 1999 and
further defined in 2006. Staff has worked with the developer on boundary street

improvements since preliminary plat approval. With the previous agreements, plan
amendments, and ordinances; staff sees no reason to modify the previous agreements
or ordinances.
Revised plat/plan: Submit four (4) copies of a revised preliminary plat/plan (to include
the additional information as noted above) to staff on Wednesday, June 11, 2014.

The applicant was present. There were no registered objectors present. Staff
presented the item stating the applicant had submitted a request dated June 12, 2014,
requesting withdrawal of this item. Staff stated they were supportive of the withdrawal
request.
There was no further discussion of the item. The chair entertained a motion for
approval of the item as presented by staff. The motion carried by a vote of 10 ayes,
0 noes and 1 absent.
