3 A RESOLUTION TO ADOPT A NEW VERSION OF THE LITTLE ROCK
4 STORMWATER AND DRAINAGE MANUAL IN ACCORDANCE WITH
5 THE CITY'S MUNICIPAL SEPARATE STORM SEWER SYSTEM(MS4)
6 PERMIT; AND FOR OTHER PURPOSES

8 WHEREAS,the current Stormwater Quality Management Program("Program")for the City's
9 Municipal Separate Storm Sewer System permit ("MS4 Permit") requires a manual to implement
10 certain elements of the Program;and,
11 WHEREAS,City Staff worked with an engineering consultant to prepare a proposed updated
12 manual that would implement the requirements of Part 2 of the MS4 Permit,among other things.
13 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
14 LITTLE ROCK,ARKANSAS:
15 SECTION 1. An updated, proposed version of the "Stormwater Management and Drainage
16 Manual"("the Manual")is hereby adopted in satisfaction of Part 2 of the MS4 Permit.
17 SECTION 2. A complete copy of the manual shall be maintained in the office of the City
18 Clerk,the Department of Planning&Development,and the Department of Public Works.
19 SECTION 3. Except as provided herein and in Section 4, the updated Stormwater
20 Management and Drainage Manual shall be in full force and effect on March 26, 2025, after passage
21 of this Resolution;provided however,that if the Arkansas Division of Environmental Quality("DEQ")
22 requires further revisions to the Manual to comply with the City's MS4 Permit, then the date of the
23 City's adoption of any such revised Manual shall be the effective date of the Manual, including any
24 revisions or updates to the Manual after the adoption of this Resolution.
25 SECTION 4. The previously adopted September 2016 Update Version of the Stormwater
26 Management and Drainage Manual shall apply to the following:
27 (a) Projects which have completed review under Little Rock City Code §§ 31-36, et seq,prior to
28 the newly updated Stormwater Management and Drainage Manual being in full force and
29 effect,or
30 (b)Projects where:
31 (1)a sketch preliminary plat under Little Rock City Code § 31-36(1)has been submitted
32 on or before September 26,2025,and

1 (2)a completed,prepared preliminary plat for consideration for approval by the Little Rock
2 Planning Commission under Little Rock City Code § 31-36(2) is submitted on or before
3 September 26,2026.
4 SECTION 5. Severability. In the event any title, section, paragraph, item, sentence, clause,
5 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
6 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
7 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
8 originally a part of the ordinance.
9 SECTION 6. Repealer. All ordinances or resolutions of the City in conflict herewith are
10 hereby repealed to the extent of such conflict.
