TWENTY-THIRD SUPPLEMENTAL BELL OF ASSURANCE
OF
CHENAL VALLEY COMMERCIAL NEIGHBORHOOD
This Twenty Third Supplement to Bill of Assurance of Chenal Valley Commercial
Neighborhood is made by Deltic Timber Corporation, formerly known as Deltic Farm and Timber
Co., Inc., (the "Developer" or the "Declarant") as hereinafter set forth.
WHEREAS, Developer caused to be filed in the office of the Circuit Clerk and Ex-Officio
Recorder of Pulaski County, Arkansas that certain Bill of Assurance of Chenal Valley Commercial
Neighborhood on September 30,1996 as Instrument No. 96-68199 (the "Original Bill of Assurance")
creating the Chenal Valley Commercial Neighborhood, a First Supplemental Bill of Assurance on
February 19, 1997 as Instrument No. 97-10852, a Second Supplemental Bill of Assurance on
November 7, 1997 as Instrument No. 97-074244, a Third Supplemental Bill of Assurance on
September 24, 1998 as Instrument No. 98-074071, a Fourth Supplemental Bill of Assurance on
December 22, 1998 as Instrument No. 98-101872, a Fifth Supplemental Bill of Assurance on

WHEREAS, Developer files this Twenty Third Supplemental Bill of Assurance to reflect the
new legal description of the Unplatted Lot 14 Property as Lot 14, The Village at Rahling Road, Little
Rock, Arkansas and the Unplatted Tract D-Property as Tract D, The Village at Rahling Road, Little
Rock, Arkansas.
NOW, THEREFORE, Developer, for and in consideration of the benefits to accrue to it, its
Successors and Assigns, which benefits it acknowledges to be of value, has caused to be made a Plat,
showing a survey made by Paul M. White, Registered Land Surveyor dated and
bearing a Certificate of Approval executed by the Department of Comprehensive Planning of the
City of Little Rock, Arkansas, and showing the boundaries and dimensions of the Real Property now
being divided into a Lot and Tract (the "Plat")
The land embraced in the Plat shall be forever known as Lot 14, The Village at Rahling
Road, -Little Rock, Arkansas and Tract D, The Village at Rahling Road, Little Rock, Arkansas, and
any and every deed of conveyance of the Lot or Tract describing the same as shown on said Plat shall
always be deemed a sufficient description thereof.
Tract D, The Village at Rahling Road, is a Common Area as described in the Bill of
Assurance of Chenal Valley Commercial Neighborhood for use as a drainage, utility and landscape
easement. Developer hereby donates and dedicates to and for the use of the public utilities, the same
being, without limiting the generality of the foregoing, electric power, gas, telephone, water, sewer
and cable television, with the right hereby granted to the persons, firms, or corporation engaged in
the supplying of such utilities to use and occupy such easements as reflected on the Plat, and to have
free ingress and egress therefrom for the installation, maintenance, repair and replacement of such
utility services.

Said land herein platted and any interest therein is hereby subject to all those certain terms,
covenants and restrictions contained in the Bill of Assurance of Chenal Valley Commercial
Neighborhood filed September 30, 1996 as Instrument No. 9668199, all of which are incorporated
herein by reference and made a part hereof and Deltic Timber Purchasers, Inc. executes this Twenty
First Supplemental to the Bill of Assurance of Chenal Valley Commercial Neighborhood for the
purposes set forth in Paragraph
h223- of the Original Bill of Assurance.
