This Ninth Supplement to Bill of Assurance of Chenal Valley Commercial Neighborhood
is made by Deltic Timber Corporation, formerly known as Deltic Farm and Timber Co.. Inc., (the
"Developer" or the "Declarant"), Joe D. White, Jr. and Kimberly H. White, husband and wife, Paul
M. White and Jennifer Jo White, husband and wife, and Timothy E. Daters and Rebecca L. Daters.
husband and wife (the "White-Daters Group"), and TPJ Properties. L.L.C. ("TPJ"), as hereinafter
set forth.
WHEREAS, Developer caused to be filed in the office of the Circuit Clerk and Ex-Officio
Recorder of Pulaski County, Arkansas that certain Bill of Assurance of Chenal Valley Commercial
Neighborhood on September 30, 1996 as Instrument No. 96-68199 (the "Original Bill of Assurance")
creating the Chenal Valley Commercial Neighborhood, a First Supplemental Bill of Assurance on
February 19, 1997 as Instrument No. 97-10852, a Second Supplemental Bill of Assurance on
November 7, 1997 as Instrument No. 97-074244, a Third Supplemental Bill of Assurance on
September 24, 1998 as Instrument No. 98-074071, a Fourth Supplemental Bill of Assurance on
December 22. 1998 as Instrument No. 98-101872. a Fifth Supplemental Bill of Assurance on
December 31, 1998 as Instrument No. 98-103569, a Sixth Supplemental Bill of Assurance on April
1. 1999, as Instrument No. 99-02667, a Sixth Supplemental Bill of Assurance on August 20, 1999

Neighborhood and subject to the Original Bill of Assurance, to -wit:

WHEREAS, Developer, White-Daters Group, and TPJ as owners of the Property, file this
Ninth Supplemental Bill of Assurance of Chenal Valley Commercial Neighborhood to reflect the
new legal description to the Property as Lot 9A, The Village at Rahling Road. Little Rock, Pulaski
County, Arkansas and of Lot 9 as Lot 9B, The Village at Rahling Road, Little Rock, Pulaski County,
Arkansas.
NOW, THEREFORE, Developer, White-Daters Group and TPJ, for and in consideration of
the benefits to accrue to them, their heirs, successors and assigns, which benefits they acknowledge
to be of value, has caused to be made a plat, showing a Survey made by Paul M. White, Registered

Land Surveyor, dated Q POO , and bearing a certificate of approval executed by the
Department of Comprehensive Planning of the City of Little Rock, Arkansas, and showing the
boundaries and dimension of lots and tracts (the "Plat'). The lands embracing the flat shall be
forever known as Lot 9A and Lot 913, The Village at Rahling Road, Little Rock, Pulaski County,
Arkansas, and any and every deed of conveyance of the lots describing the same as shown on said
Plat shall always be deemed a sufficient description thereof.
Said land herein platted and any interest therein is hereby subject to all those certain terms,
covenants and restrictions contained in the Bill of Assurance of Chenal Valley Commercial
Neighborhood filed September 30, 1996, as Instrument No. 96-68199 and all supplements and
amendments thereto. all of which are incorporated herein by reference and made a part hereof and
Deltic Timber Purchasers, Inc. executes this Ninth Supplement to the Bill of Assurance of Clienal
Valley Commercial Neighborhood for the purposes set forth in paragraph 23 of the Original Bill of
Assurance.
