WHEREAS, in accordance with Ordinance No. 16, 710 passed on July 19, 1994 amending Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, it is desirable that all of the above -described lands be platted as a Planned Office District ("POD"). NOW, THEREFORE, CB&H, LLC, an Arkansas Limited Liability Company, hereinafter called "Grantor" has caused said tract of land to be surveyed by White-Daters and Associates, Inc., a Registered Professional Engineer, and a final site development plan/plat (the "Plat") thereof made which is identified by the title "Lot 1, Fairview Kennels Addition to the City of Little Rock", the date 1 ;�1 q q 9 1 , and which bears the signature of the said Engineer, and bears a Certificate of Approval executed by the Little Rock Planning Commission, and is of record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, in Plat Book ' at Page , and the Grantor does hereby make this Bill of Assurance. The Grantor does hereby certify that it has laid off, platted and planned development, and does hereby lay off, plat and plan development of the above described lands in accordance with the above -described Plat. The lands embraced in said Plat shall be forever known as LOT 1, FAIRVIEW KENNELS ADDITION TO THE CITY OF LITTLE ROCK. Grantor hereby dedicates to the public forever an easement on and over the additional five (5) feet of right-of- way for Pleasant Ridge Road as shown by said Plat, to be used as a public street. Owners of the Lot in this POD shall take title subject to the rights of the public to the use of said street easement. The filing of this Plat and Bill of Assurance for record in the office of the Circuit Clerk and Ex- Officio Recorder of Pulaski County, Arkansas, shall be a valid and complete delivery and dedication of the street easement shown on the said Plat. Hereafter, conveyance and description of any of said lands by lot number as shown on said Plat shall be a proper and sufficient description thereof. The Lot in said POD shall be sold by the Grantor and shall be purchased by the buyers thereof subject to the following covenants: 1. The Lot shall not be subdivided and no building shall be erected or placed on the Lot except in accordance with the requirements of the Plat. 2. No building or fence shall be constructed on the Lot nearer to the front street than the minimum building line shown on said Plat. Page 2 of 4 3. No building, incinerators, paved driveways, or any other permanent structure or improvement of any kind, whether herein specifically enumerated or not, shall be built or maintained within the area of the easement shown on the Plat, and in the event any such obstruction is placed thereon in violation of this restriction and reservation, the City of Little Rock will not be liable for destruction of same in maintaining or repairing its street located within the area of said easement. 4. These covenants and restrictions are to run with the land and shall be binding on all owners of the Lot in the POD and all persons claiming under them for a period of time equal to the time period the aforesaid Ordinance No. 16, 710 of the City of Little Rock is in full force and effect. 5. These covenants and restrictions shall not be amended, cancelled, or supplemented unless an amended Plat and amended Bill of Assurance signed by the Grantor and approved by the Little Rock Planning Commission is placed of record agreeing to change the covenants and restrictions in whole or in part. 6. In the event any attempt to violate any of the covenants or restrictions herein occurs before the expiration date hereof, it shall be lawful for any person or persons injured by such attempt to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenant or restriction, and either to prevent him, her or them from so doing or to recover damages in any court of law for such violation. 7. This Bill of Assurance shall be appended to the final Plat as approved by the Little Rock Planning Commission. Any dedication or restriction shown on either document shall be considered to appear on both, but should any discrepancy appear, the final Plat shall govern. 8. The invalidation of any one of these covenants or restrictions by judgment of a court of competent jurisdiction shall in no wise affect any of the other provisions which shall remain in full force and effect.
