50 ft. strip of land owned by the City of Little Rock; thence N86033'51 "W
along said north line, 365.28 ft. to the point of beginning, containing 9710
sq. ft. or 0.2229 acres more or less.
WHEREAS, it is the desire and intent of Chuck Hutton Leasing Co. that the
operation of businesses in the T.H.J.R. Addition, an Addition to the City of Little Rock,
Arkansas, business signs and other appurtenances placed within said subdivision, be
designated and placed in such a manner that their location and orientation on the Lots
are individually and collectively useful, attractive and in compliance with the PD-C plan.
AND WHEREAS, it is desirable that the above described property be subdivided
into Lots with a private street or driveway shown as an ingress -egress easement;
NOW THEREFORE, WITNESSETH THAT, the said Chuck Hutton Leasing Co.,
a Tennessee Corporation, hereinafter termed "Grantor" has caused said property to be

surveyed and platted ("the Plat") by Paul M. White, Registered Land Surveyor. The Plat
is identified by the title T.H.J.R. Addition, an Addition to the City of Little Rock, Arkansas,
dated the _ day of
1997, and recorded in Plat Book at
page`" 2-in the records of the Circuit Clerk. The Grantor hereby makes this Bill of
Assurance which accompanies the Plat.
The Grantor hereby certifies that it laid off, platted, and subdivided said lands in
accordance with the Plat. The lands embraced in the Plat shall forever be known as Lot
1 and Lot 2 T.H.J.R. Addition, an Addition to the City of Little Rock, Arkansas, and
conveyance of said lands by Lot number shown on the Plat shall be considered a
complete and proper description thereof.
There are strips of ground shown in dimensions on the Plat marked "Easement"
which are reserved for the use of public utilities or for drainage purposes, showing
access at all times to the easements herein reserved for the providers of utility services,
except that said "Easements" and a fifty (50) foot strip of land owned by the City of Little
Rock for such public utilities and the Lot owners may also serve the land and be used
for access to and from the land within the T.H.J.R. Addition, an Addition to the City of
Little Rock, Arkansas. Owners of Lot 1 and Lot 2, T.H.J.R. Addition, Addition to the City
of Little Rock, Arkansas shall take their title subject to the rights of public utility providers.
The filing of this Bill of Assurance and the Plat for record in the office of the Circuit
Clerk and Ex-Officio Recorder in Pulaski County, Arkansas shall be a valid and complete
delivery and dedication of the easements shown on the Plat subject to the reservations
provided in the prior paragraphs.

The Lots sold or held by Grantor and purchased by any Buyer are subject to the
following restrictive covenants:
1. The ingress -egress easement marked on the Plat is a private street or
driveway. Maintenance will be done by the Lot owners from a maintenance fund. On
January 1, 1998, and each year thereafter the Lot owners will deposit $1,000.00 each to
the maintenance fund which shall be an account at a mutually agreed upon bank.
Repair and maintenance will be paid from the fund as agreed upon by the Lot owners.
2. No public address system shall be used or operated by any business
operated on either lot.
3. Set -back lines shall conform to the Little Rock Zoning Ordinance zoning
classification then affecting the Lots. The maximum hours of operation for businesses
on both Lots are 7:00 a.m. to 8:00 p.m.
4. If either Lot is used for selling automobiles, trucks, equipment, tractors and
similar items (vehicles) all unloading will occur on the Lot used for such purpose.
5. No automobile body repair or rebuilding can be performed on Lot 2. Only
service work may be performed on the new or used vehicles sold by the owner of Lot
2.
6. The owner of Lot 1 is granted an easement of ten (10) feet across running
West from the West line of the ingress -egress easement and running twenty-five (25) feet
North"from the South property line to the twenty-five (25) foot Building set -back line. The
directional sign shall be maintained by the owner of Lot 1.

7. The ingress -egress easement, private street or driveway shown on the Plat
filed herewith and granted to the Lot owners is also an easement for persons, firms or
corporations engaged in supplying utility services, the same being without limiting the
generality of the foregoing, electric, power, gas, telephone, water and sewer. Those
persons, firms or corporations shall have the right to use and occupy said ingress -egress
easement for the installation, maintenance, repair and replacement of such utility services
as are necessary to supply such services to the Lots in the T.H.J.R. Addition, Addition
to the City of Little Rock, Arkansas. Easements for the installation, maintenance, repair
and replacement of utility and services, sewer and drainage have heretofore been
reserved, said easements being of various widths, reference being hereby made to the
Plat filed herewith for a more specific description of the width and location thereof. No
excavations within the area of such easements or on said 50 foot strip owned by the City
of Little Rock for the erection of any improvements or fences (wood, wire, stone, brick,
or any other material) or for any other purposes shall be made which would interfere with
the installation, maintenance, repair and replacement of any utility facilities and services
without such utility providers' or owner's prior consent. If necessary to reach a suitable
point of delivery, each future Lot owner in this subdivision agrees to donate, free of
charge to the utility involved, additional adequate easements.
B. The covenants and restrictions are to run with the land and shall be binding
on all parties claiming under them for a period of fifty (50) years from the date of
recording, after which time said covenants and restrictions shall automatically be
extended for successive periods of twenty-five (25) years, unless an instrument signed

by fifty-one percent (51%) of then owners of the Lots in the T.H.J.R. Addition, Addition
to the City of Little Rock, Arkansas is recorded, agreeing to change said covenants and
restrictions in whole or in part. Any change must be approved in writing by the Little
Rock Planning Commission.
9. In the event of any violation or attempt to violate any of the covenants or
restrictions herein, before the expiration date hereof, it shall be lawful for any persons,
person or legal entity owning a Lot or Lots in the T.H.J.R. Addition, Addition to the City
of Little Rock, Arkansas, to prosecute any proceedings at law or in equity against the
person, persons, or legal entities violating or attempting to violate any such covenant or
restriction, and either to prevent him, it or them from so doing or to recover damages or
other amounts for such violation.
10. The invalidation of any one of these covenants and restrictions shall in no
way affect any of the other provisions, which shall remain in full force and effect.
