3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN
5 ANNUAL MAINTENANCE AND EQUIPMENT UPGRADE AGREEMENT
6 IN AN AMOUNT NOT TO EXCEED SIXTY THOUSAND, EIGHT
7 HUNDRED THIRTY DOLLARS ($60,830.00), PLUS APPLICABLE TAXES
8 AND FEES, FOR THE CITY'S OUTDOOR WARNING SIREN SYSTEM
9 WITH SAFETYCOM ;AND FOR OTHER PURPOSES.

11 WHEREAS,in 2004,the City of Little Rock(the"City")selected Safetycom as the lowest responsible
12 and responsive vendor responsive to Solicitation No. 03287 to manufacture, build, and install the City's
13 Outdoor Warning Siren System; and,
14 WHEREAS, Safetycom is the original manufacturer and builder of the City's Outdoor Warning Siren
15 System and thus the sole provider for on-call repair and service of the system since the initial 2004 award;
16 and,
17 WHEREAS, the Emergency Management Division is committed to providing for the maintenance,
18 operation,and equipment upgrades of the City's Outdoor Warning Siren System throughout the City,and,
19 WHEREAS, to ensure this goal is met, the Emergency Management Division proposes the City
20 Manager enter into an annual overall Maintenance and Equipment Upgrade Agreement with Safetycom for
21 the period of one (1) year, at a cost of Sixty Thousand Eight Hundred Thirty Dollars ($60,830.00), plus
22 applicable fees and taxes.
23 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
24 OF LITTLE ROCK,ARKANSAS:
25 Section 1. Because Safetycom is the original manufacturer and installer of the City's Outdoor
26 Warning Siren System and the sole provider of on-call repair and service,the Board of Directors of the City
27 of Little Rock declares it is impractical and unfeasible to submit this purchase to competitive bids.
28 Section 2. The Board of Directors hereby authorizes the City Manager to enter into a sole-source
29 Maintenance and Equipment Upgrade Agreement with Safetycom, for the period of one (1)year, in a total
30 amount not to exceed Sixty Thousand Eight Hundred Thirty Dollars ($60,830.00), plus applicable fees and
31 taxes.
32 Section 3. Funds for this program are available from the City of Little Rock's Emergency Management
33 General Budget Account No. 101007-63390.

2 Section 4.Severability.In the event any title,section,paragraph,item,sentence,clause,phrase,or word
3 of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration or adjudication
4 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the
5 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
6 Section 5.Repealer.All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
7 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
8 Section 6. Emergency Clause There is hereby found and declared to be an immediate need for the
9 maintenance and equipment upgrade of the City Outdoor Warning Siren System which benefits the public
10 health, safety, and welfare of the City and its inhabitants;an emergency is, therefore, declared to exist and
11 this ordinance shall be in full force and effect from and after the date of its passage.
