BACKGROUND: On October 10, 1996, the Planning Commission approved a preliminary plat for the subdivision of a 2.75 acre parcel with an existing single-family home into two lots. The approval was subject to conditions noted by staff. On November 7, 1996, the Board of Directors approved a conditional waiver of street improvements to Kanis and Asbury Roads, and on April 15, 1997 a resolution was passed granting a driveway access to Kanis Road. According to Chapter 31 of the Little Rock Code of Ordinances Section 31-94(e), "A preliminary plat approved by the Planning Commission shall be effective and binding upon the Commission for one (1) year from the date of approval or as long as work is actively progressing, at the end of which time the final plat application for the subdivision must have been submitted to the Planning Staff." "The Planning Commission may extend the original preliminary approval, for a period not to exceed one (1) year from the date of approval, when it can be demonstrated that there are no changes in the plat design or neighborhood that warrant a complete review." As of this date, the final plat application for the subdivision has not been submitted to the Planning Staff. April 30, 1998 SUBDIVISION ITEM NO.: 3 Cont. FILE NO.: 5--1110 B. PROPOSAL: The applicant has submitted a letter to staff requesting a one year extension for the submittal of a final plat application, until April 15, 1999. The reasons and justification for the time extension are outlined in the attached letter. There have been no changes to the original plat design as approved by the Planning Commission. C. STAFF RECOMMENDATIONS: Staff recommends approval of the one (1) year time extension as requested by the applicant. The applicant will have until April 15, 1999 to submit a final plat application to staff. There are no graphics for this item. PLANNING COMMISSION ACTION: (APRIL 30, 1998) The staff presented a positive recommendation on this application, as there were no further issues for resolution. There were no objectors to this matter. The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as recommended by staff. A motion to that effect was made. NEW STREET: 0 ZONING: R-2 PROPOSED USES: Single Family PLANNING DISTRICT: 18 Ellis Mountain CENSUS TRACT: 42.06 VARIANCES REQUESTED: Deferral of road improvements along Kanis Rd. BACKGROUND• The applicants wish to create a lot for their daughter and her family to construct a single family on Lot 1. A. PROPOSAL/REQUEST: To split a 2.75 acre parcel with an existing single family home into two lots. Access to the proposed Lot 1 will be via a 20 foot easement from Asbury Road across Lot 2. The existing home on Lot 2 will continue to use a concrete driveway from Asbury Road as access. B. EXISTING CONDITIONS: The land is flat and heavily wooded. There are no existing curb, gutter or sidewalk improvements on Asbury or Kanis Roads. Surrounding land uses consist of large lot (one acre plus) single family homes. C. ENGINEERING COMMENTS: PUBLIC WORKS COMMENTS Dedication of right-of-ways as indicated on the plat appeared to me to Master Street Plan standards. Prefer the plat of lots (1) and (2) be rotated 90 degrees, so that lot (1) would take access from Asbury Road verses the minor arterial Kanis Road. Master Street Plan calls for Asbury Road to be built to a residential street standard 27 feet wide with a sidewalk. Kanis Road is a minor arterial to be constructed 60 feet wide with the sidewalk on both frontages. The corner radius would be improved to 25 feet and handicap accessible ramps would be constructed at the intersection for both sidewalks. Driveways for residents should be constructed and should be built in a way that would not interfere with future public right-of-way improvements specifically the grade of the driveways and a proper transition for sidewalk grades. E. UTILITY COMMENTS/FIRE DEPARTMENT Wastewater: Sewer main extension required with easements. Arkla: No comment Southwestern Bell: OK Water: The water meter for each lot should be adjacent to the lot served. Location of the existing meter needs to be determined. A pro rata front footage charge of $13/foot applies for connections off Asbury Road. AP&L : No comment Fire Department: No comment County Planning: No comment Planning Division: No comment Landscape: No comment F. ISSUES TECHNICAL DESIGN 0 All outstanding planning issues have been resolved. G. ANALYSIS The applicant has worked with Planning and Public Works staffs to resolve staff concerns. A 20 foot easement has been added to provide access to Lot 1 for Asbury Road. At staff request Lot 1 will be denied access from Kanis Road. STAFF RECOMMENDATIONS: APPROVAL of preliminary plat subject to the conditions listed in paragraphs D and E of this staff report. SUBDIVISION COMMITTEE COMMENT: (SEPTEMBER 19, 1996) Mr. Hawkins was present to discuss the preliminary plat. David Scherer outlined the future improvements planned for Kanis Road and the reasoning to deny a driveway access from Kanis Road by Lot 1. There was a great deal of discussion in respect to the existing conditions of the roadways and the projected future traffic volumes. Mr. Hawkins stated that he would consider providing an access easement from Asbury Road for Lot I. The item is to be forwarded to the full Commission for determination. PLANNING COMMISSION ACTION: (OCTOBER 10, 1996) This item was included in the Consent Approval agenda. A motion to approve the Consent Approval agenda. On April 30, 1998, the Planning Commission granted a one (1) year extension to final plat, until April 15, 1999. B. PROPOSAL: On June 17, 1999, the applicant submitted a letter to staff requesting an extension for the submittal of a final plat application. The reasons and justification for the time extension are outlined in the attached letter. There have been no changes to the original plat design as previously approved by the Planning Commission. The applicant has informed staff that an extension until the end of this year will be sufficient. C. STAFF RECOMMENDATIONS: Staff recommends approval of the time extension as requested by the applicant. The preliminary plat will,be reinstated and the applicant will have until December 31, 1999 to submit the final plat application to staff. PLANNING COMMISSION ACTION: (AUGUST 19, 1999) The staff presented a positive recommendation on this application, as there were no further issues for resolution. There were no objectors to this matter. The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as recommended by staff. A motion to that effect was made. The motion passed by a vote of 6 ayes, 0 nays and 5 absent. 2 T4ey�_ # l S-010 June 16, 1999 Mr. Monte Moore Subdivision Administrator Department of Neighborhoods & Planning City of Little Rock Re: Case 5-1110 Dear Mr. Moore: On March 13, 1998 I delivered to you a letter requesting an extension of time for filing our final plat on a residential sub- division titled Berta replat. The request was necessary due to the illness of my wife, who had cancer. The planning commission agreed to a 12 month extension which would be to April, 1999. On December 26, 1998 my wife passed away, and because of this we could not do anything with the property, plus it didn't register with me that we had the dead- line approaching in April. ' We are now ready to build a residence on Lot 1 of Berta Replat. This is the East lot. This will be a one story single family residence. Will you present a request to the Planning Commission at their August 19, 1999 meeting to permit us to file a final plat for construction of this residence. It is my understanding that we may apply for a building permit as soon a we comply with the filing requirements of the final plat, as outlined in your literature.
