THAT WHEREAS, Perry County Bancshares, Inc. (herein referred to as
"Grantor") is the owner of the following described property in Pulaski County, Arkansas:
PART OF THE NORTH 1/2 OF SECTION 16, T-2-N, R-14-W, PULASKI COUNTY,
ARKANSAS, MORE PARTICULARLY DESCRIBED AS: --
COMMENCING AT THE NE CORNER OF SAID SECTION 16; THENCE N 88'11'36" W

by the title "Lot 2, Phase I ,Morgan PUD, Pulaski County, Arkansas". The plat bears the
seals and signatures of Robert C. Lowe, Jr., Registered Professional Land Surveyor, and
Patrick M. McGetrick, Registered Professional Engineer, the signature of the Grantor, a
Certificate of Approval by the Little Rock Planning Commission, and is filed for record in
the office of the Circuit County Clerk of Pulaski County, Arkansas, as Plat
The Lands embraced in the said plat shall be forever known as Lot 2 - Phase I,
Morgan PUD, Pulaski County, Arkansas, and all conveyances of the said lot shall bear this
description.
The filing of the plat for record in the office of the Circuit County Clerk and ex-
officio Recorder of Pulaski County shall constitute a complete and valid delivery of any
easements and/or rights -of -way shown on the Plat.
The lot shown on this plat shall be used only for residential purposes, and no
building shall be constructed nearer to the street than the building lines shown hereon.

RE: Highway 10 & Morgan Cemetary Road Property
Dear Brent!
Tnank you for putting into writing your thoughts and your desires concern-
ing the Morgan Ceiretary Rd. property. In response to that, I want to recap
the process.
I turned in the order for the survey and the final plat to McGetrick Engin-
T eering on 3/3/96. I asked for the corners to be marked ane the measurments
of the property on the east side of Horgan Cemetary Rd. and the easements
between Lots 2 & 3 to be removed and the 50, buffer on tie lot to remain
with Lot I.
- I inquired with McGetrick Engineering a`5out dividing the 2 acres off o`
the PUD. Pat MtC_ trick spoke with Bobby Sims at the Planning connission
and was informed that the property could be final platte,3 into 2 lots
instead of 3. There would probably not be any improvements req<.uired. It
would take about a week to a week and a half until we would know for sure
what the city might require. Mr. Hill was in agreement to go ahead and
have the final plat filed.
hl On 4/1/96, I spoke with Pat McGetrick Vho said that David Sherer filed the
Ul plat and he was waiting to hear from nim as to whether or not the city was
going to make any requirements in filing this plat.
On 4/4/96, Pat McGetrick said that the Subdivision Committee was to meet and
that everything should be just fine. Ile also safe] that he would get the sur-
vey to Lender's before Wednesday, 4/10. However, it dil not.
on 4/15/96, Steve at McGetrick Engineering sail the survey was being gent to
Lender's and the plat was going for approval by the end of the week. Why
this plat approval continued to stretch out and stretch out, I do not know.
1 continued, to no avail, tc contact McGetrick Engineering to find out AY
we did not have an answer to this question. Lender's was calling Mcoetrick
Engineering at that point to find out about a survey so that the closing
could taktplace.
on 4/17/96, a survey on the back tracts was sent to Lender's. I was still
concerned at that point about not having an arsver to the question about
Vnether or not a final prat needed to be filed, or if the back tracts could
be sold off without the entire property being final platted. I spoke with

Bob Lowe at McGetrick Engineering and ? had him speak with Rob Hill on a
conference call so that he could explain to Mr. Hill how we would be clos-
ing on the property without a final plat being filed.
Yes, Richard Woods, I do know that when a piece of property is divided into
less than, 5 acres the city has to approve it by giving a plat. However, Bob
Lowe told Mr. Hill that it could 1* sold off separately, but that they would
risk losing the PUD that was on the entire property. It was at that point
that Mr. Hill said to go ahead and close that way, that the buyer had been
very patient, he said we had a survey on his tract and the city said that
as long as Brent t rell intended to use the property as an e tgnsion of his
ownership there, (wh+r -ii w4at you said your intentions were) that there
shoo not be a p.:ohlem-
At that point, on 4/29/96, I suggested that you call the city yourself since
I represent the sellers, and talk with them so that you would fully under-
stand the way that we were going to close the property. You said that you
would discuss it with Bobby Sims. I told you that by your calling Bobby Sims,
he might take a different look and it could make it more difficult on the
sellers, but I wanted all the facts told to you from the "horse's mouth".
After your conversation with Richard Woods and your letter to me, I contact-
ed Ms. Hi11 to tell him that you wanted to have the property final platted.
Iie said that was fine, to go ahead and call McGetriek Engineering again and
tell them we Want to have the property final platted and to find out what
requirements were going to be made by the city.
Today, 5/9/96 I have spoken. with Pat MicGetrick. After numerous phone calls
to he and Steve Bridges with none of them being returned, I was able to talk
to Steve and Pat. They said the plat was at the city and we should know
tomorrow or Monday if everything is okay. The sellers would need to sign it
and have it filed. When as'-�ed why this has ?rug out s❑ long, Pat Mc'etricF:
