BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That a variance from various lot design standards of Chapter 31 of the Code of Ordinances is granted to provide for variances of certain requirements within the Subdivision Regulations of the City of Little Rock for the Capitol Lakes Estates Tract A — Governors Manor - Subdivision Preliminary Plat (S-1100-E) as follows: Subsection A. That variances are granted from the provisions of Chapter 31, Section 31-232(a) to allow Lots 2 — 35 and 38 - 44 to develop with a reduced lot width. Subsection B. That variances are granted from the provisions of Chapter 31, Section 31-232(a) to allow Lots 1 — 34 and 37 - 45 to develop with a reduced lot depth. Subsection C. That variances are granted from the provisions of Chapter 31, Section 31-232(a) to allow Lots 2 — 35 and 38 - 44 to develop with a reduced minimum lot area square footage. Subsection D. That variances are granted from the provisions of Chapter 31, Section 31-256 to allow Lots 1 — 45 to develop with a reduced front building line. SECTION 2. This ordinance shall take effect thirty (30) days from and after its passage. Sincerely, Donna James, AICP Subdivision Administrator OFFICE OF THE CITY MANAGER LITTLE ROCK, ARKANSAS BOARD OF DIRECTORS COMMUNICATION JANUARY 4, 2005 AGENDA Subject An Ordinance establishing variances from the Subdivision Ordinance for the Capitol Lakes Subdivision (S-1100-E), located North of Capitol Hills Boulevard at Rushmore Avenue Action Required gOrdinance Resolution Approval Information Report Submitted By Bruce Moore City Manager SYNOPSIS The applicant is requesting the following variances from the Subdivision Ordinance in developing 9.12 acres with 45 single-family lots: 1. A variance to allow a reduced front lot width on selected lots. 2. A variance to allow a reduced lot depth on selected lots. 3. A variance to allow a reduced minimum lot square footage on selected lots. 4. A variance to allow a reduced front yard building line on selected lots. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested variance. The Planning Commission voted to recommend approval of the requested variance, as recommended by Staff, by a vote of 9 ayes, 0 noes and 2 absent. CITIZEN The Planning Commission reviewed the proposed variance PARTICIPATION request at its April 22, 2004 meeting. There was one objector present. All abutting property owners of the site and the Spring Valley Manor Neighborhood Association were notified of the Public Hearing. BACKGROUND The applicant is requesting the subdivision of this 9.12- acre site into 45 single-family lots through a Planned Residential Development plat/plan (a separate item on this agenda File No. Z-6120-J). The proposed request will result in a density of 4.9 units per acre. There are several waivers and variances being requested as a part of the development. The applicant has requested a reduced front building line, a reduced lot depth, a reduced lot width on several of the proposed lots and a reduced minimum lot area square footage. The applicant has also indicated the subdivision will be gated and will be developed with private streets. To Staff s knowledge, there are no outstanding issues associated with the proposed request.
