OF LOTS: 3 FT. OF NEW STREET: 0 ZONING: "R-2" PROPOSED USES: Office, Quiet Business A. EXISTING CONDITIONS The site is situated on what can basically be described as hilly land. It faces Barrow Road on the west, and is bordered by Labette Drive, and the Brownwood Subdivision on the north and east, respectively. No drainage problems are apparent. B. DEVELOPMENT PROPOSAL This is a proposal to develop an area of three acres into two lots for Office/Quiet Business use. One variance, for a waiver of 1/2 improvements to Barrow Road, has been requested by the applicant. The justification offered is due to•imminent construction contracts by the City. No legal problems are apparent at this time. October 13, 1981 SUBDIVISIONS Item No. 2 - Continued C. ENGINEERING CONSIDERATIONS Recommends denial of request to waive improvements on Barrow Road. Engineering requests that the applicant contribute an in lieu cost for improvements along the property front on John Barrow. D. ANALYSIS Staff is not in opposition to the plat as presented. However, adequate justification has not been presented for a waiver of improvements to Barrow Road; therefore, Staff is not in support of this variance. E. STAFF RECOMMENDATION Approval of the plat only, subject to Staff's and Engineering's comments. F. SUBDIVISION COMMITTEE ACTION Bob Richardson, engineer for the project, represented the applicant. The Committee decided that adequate justification for a waiver of improvements on Barrow Road had not been submitted. Engineering reported that the in -lieu cost for improvements along John Barrow would be $26,500. The Committee decided to approve the plat without the variance by a vote of 3 ayes, 0 noes and 2 absent. PLANNING COMMISSION ACTION The applicant was present. There were no objectors. The applicant asked that the proposal be modified to include a request for the staging of improvements on Barrow Road instead of a total waiver. A motion to approve the plat as modified was made, but failed to pass by a vote of 2 ayes, 5 noes and 4 absent.* A substitute motion for the approval of the plat without the variance was made and passed by a vote of 7 ayes, 0 noes and 4 absent. (* Nay votes, Commissioners Johnson, Nicholson, Wright, Massie and Arnett)
