NEW ST.: 0 ZONING: "R-2" PROPOSED USE: Single Family VARIANCES REQUESTED: Side yard encroachment for raised patio STAFF REPORT: This is a request to revise a final plat by establishing side yard setbacks as shown on the enclosed final plat. The proposed side yard will be a l' side yard along one side of the lot extending from 10' beyond the front yard setback to 30' from the rear lot line. The remainder of the side yard setback lines will be the normal 10 percent of the lot width. This request is to allow the construction of a raised patio deck to within 1' of the lot line. It applies to all lots except Lots 5, 6, 9, 20, 24, 25, 28, 32, 38, 42 and 44 which have side yard easements prohibiting this concept. The applicant is also requesting that no final plat be recorded at the courthouse, although he will record an amended Bill of Assurance. ENGINEERING COMMENTS: None. June 11, 1985 SUBDIVISIONS Item No. 4 = Continued ANALYSIS: Staff has no problem with the request; however, the applicant should file a revised final plat at the courthouse. gTAFF RECOMMENDATION: Approval, subject to comments. SUBDIVISION COMMITTEE REVIEW: The applicant agreed to: (1) provide some criteria for the deck in the Bill of Assurance and plat, and (2) file a final plat at the courthouse. PLANNING COMMISSION ACTION: The applicant submitted a revised plan in accordance with the Subdivision Committee's wishes. A motion for approval was made and passed by a vote of: 9 ayes, 0 noes and 2 absent.
