VARIANCES: To allow reducing building line.
APPLICANT: Spurgeon Memorial Baptist Church
LOCATION: Southwest Corner of Woodson Road
and Fisher Drive
REQUEST:
To reduce the platted building line on the north side of the
lot abutting Fisher Drive (from 25' to 151).
STAFF ANALYSIS
This proposal involves a church and its expanison program
which calls for addition on the north side of the building.
The proposed intrusion of 7' more or less would be used for
baptistry and office space. The church has stated in its
justification that a corner lot imposes two front yard
relationships and that Fisher is a dead-end street and
" little used.
The addition would have no doors to the north but would open
east and west to allow interior circulation between
classrooms by means of canopy covered walks.
STAFF RECOMMENDATION
A visit to the site suggests to us that there are perhaps
other options open to this church where no encroachment
would be necessary. We would like to point out that certain
exceptions have already been granted to this ownership by
waiver of street improvements on Fisher Road. As to the
road being a dead-end, that is the case for the present.
However, a mobile home park is the only hinderance to its
extension to connect with Forbing Road at Geyer Springs
Road. The permanence of mobile home parks along a major
arterial street zoned commercial and apartment is
questionable. Therefore, it is conceivable that Fisher may
be extended. We would recommend denial of the request.
SUBDIVISION COMMITTEE RECOMMENDATION:
Approval as filed. The vote - 5 ayes, 0 noes.
PLANNING COMMISSION ACTION:
After a brief discussion, the Commission voted to approve a
modified building line allowing 15' where necessary to
accomodate the building additions. The vote - 6 ayes,
0 noes, 4 absent and 1 open position.

No adverse comments have been received from neighboring property
owners. Site plan review by the Planning Commission is scheduled
for July 31.
Staff fully supports this PUD development concept and believes
that this site is particularly attractive for this proposal.
STAFF RECOMMENDATION:
Staff recommends approval of the PUD with the condition that the
site plan approval is granted.
COMMISSION ACTION - July 29, 1980:
The applicant was present and described the proposed project in
great detail and discussed the rationale for approaching this
development in the manner proposed. There were no opponents
present. There were, however, a few neighboring property owners
who raised a number of questions and discussed the project both
with the Planning Commission and with the applicant. After a
lengthy discussion, the Commission moved to approve the
application with the condition that site plan approval be granted
a future meeting. The motion was approved - 7 ayes, 0 noes, 3
absent and 1 abstention. (George Wittenber abstained citing
conflict of interest.)
SUBDIVISION COMMITTEE RECOMMENDATION:
Approval of PUD Site Plan and Plat/with changes:
1. The plat to reflect two lots ( separate for house) .
2. Move pool use area.
3. Access drive to be on west one-half of access lot and + 25'
from the west line.
4. Access to Cantrell to be perpendicular.
5. Access drive to be 24' pavement in a 45' easement which
may be modified in width to accommodate design.
6. Preparation of final plat to be filed for record.
The vote - 4 ayes, 0 noes and 1 abstaining (George
Wittenberg).
PLANNING COMMISSION ACTION:
Approval as recommended by the Subdivision Committee except that
the plat be allowed as 3 lots. The vote - 6 ayes, 0 noes, 4
%., absent and 1 open position.
