STAFF ANALYSIS:
This is a request by the applicant to revise a "PRD" and
Bill of Assurance that was approved by the Planning
Commission on June 9, 1981. The original intent of the
project was to provide more open space for the units by
providing a zero -lot -line type development with common
walls. The applicant is now asking t❑ extend 12' into areas
established on the Final as the building line, by
constructing a deck with a gable -type roof on the units.
Staff is not in favor of this request as filed, but may be
willing to approve the deck without the construction of the
roof.
STAFF RECOMMENDATION:
Denial as filed.
SUBDIVISION COMMITTEE ACTION:
The applicant was present. There was considerable
discussion. The Committee decided that the request involved
a structural intrusion into the building line, which the
approved PRD Final was not designed t❑ accommodate, because
of a change in character of the plat. The applicant was
given a choice of pursuing this course of action, which
would require Planning Commission and Board approval, an
amended plat and Bill of Assurance, and a statement from
owners and current buyers stating their consent; or the
option of providing an uncovered deck, which was not
considered to be a structural intrusion. The applicant was
instructed to inform the staff of their decision. A motion
was made and passed to send this to the Planning Commission
without recommendation. The vote: 5 ayes, 0 noes and
0 absent.

PLANNING COMMISSION ACTION:
There were no objectors present. Joe White was present and
offered comment dealing with the Subdivision Committee
recommendation. He offered evidence that the purchasers of
lots and units within Woodland Hills did not oppose the
changes. He stated that the owner was willing to file an
amended plat and Bill of Assurance to provide for the design
changes, that specifications for the addition would be
included limiting the covered deck to three open sides,
maximum of 10' intrusion beyond the building line and a 12'
maximum dimension parallel to the residence.
Mr. White offered a prepared statement confirming his
remarks. The staff modified its position to one of approval
as amended by this report. The Commission discussed the
matter as to criteria for construction and determined to
accept that which was offered. The Commission voted to
approve the revised plat and Bill of Assurance in line with
the commitment made by Mr. 'Thomas. The vote: 9 ayes,
0 noes and 2 absent (Tabor and Rector were absent).
