STAFF REPORT
A. EXISITING CONDITIONS

The property involved is located in a rural area that
is west of Little Rock, and off Stuart Road. The land
can generally be described as wooded, with a gently
rolling terrain. No drainage problems are apparent.
City water and sewer are not available in the area.
B. DEVELOPMENT PROPOSAL
This is a proposal to plat this 49 acre tract into
eight lots, ranging from five to seven acres apiece,
for single family use. The only access to each of
these lots will be from Country Oaks Drive, a
cul-de-sac of approximately 2,790' in length. The
applicant is requesting that the Ordinance requirements
be waived to allow this. At the time of this writing,
no justification has yet been received. As a matter of
record, Lots B and G have already been sold.
1. Conformance to Ordinance
This plan varies from the Ordinance in the manner
stated above. There are also several minor
deviations that are related to the form and
content of the plat, such as the specification of
corner angles, names of adjacent property owners,
and a vicinity map, etc.

2. Legal Considerations
None at this time.
3. Engineerinq Considerations
Stuart Street is a collector street; however, this
property has provided sufficient right-of-way.
The developer's engineer should provide planned
drainage easements and submit plans for Country
Oaks Drive street construction to City Engineerig
for approval.
C. ANALYSIS
Initially, this development was already in progress
when it was brought to our attention. Since it is in
our extraterritorial jurisdiction, a special agreement
between the City and County staff is being utilized for
the review of the matter.
The Pulaski County Planning Agency has requested that
Staff investigate this matter and take any necessary
action to bring this development into line with the
City's current subdivision rules and regulations.
Certain County standards for public improvements are
still to be used, however. They are: (a) 60'
right-of-way; (b) 28' crown width; (c) 6" crushed stone
base; (d) 20' wide, 2" thick hot mix asphalt concrete;
(e) adequate drainage and drainage tiles; (f) pipes and
culverts designed to pass a 10 year flood.
City Staff has no problem in particular with the waiver
of the Ordinance required cul-de-sac length of 7501.
No adverse effects are expected. The applicant,
however, will still be required to comply with all of
the basic requirements as to form and content.
D. STAFF RECOMMENDATION
Approval subject to the comments by Staff, Engineering
and the County.

SUBDIVISION COMMITTEE RECOMMENDATION
Mr. Joe Barnswell, the applicant, offered justification For
his request for a waiver of the cul-de-sac length
requirement: the existence of an easement for ingress and
egress, only 1081 wide and 650' in length off of Stuart Road
t❑ the first tract of the eight tracts. The Committee made
and passed a motion that was in agreement with Staff's
recommendation for approval subject to the stated comments.
The vote was: 3 ayes, 0 noes, 2 absent.
PLANNING COMMISSION ACTION
The Planning commission considered a letter from the
applicant that requested withdrawal of this application and
the refund of 25 percent of t'he filing fee. A statement
from the County indicating that the applicant has agreed to
conform with its public improvements and platting
requirements was submitted. A motion to approve was made
and passed. The vote was: 7 ayes, 0 noes, 4 absent.
