Building Line Waiver
LOCATION: #51 Brookview Drive
STAFF REPORT
A. EXISTING CONDITIONS
This site is in a well kept residential subdivision
that is located on gently sloping land. The property
involved is sited to create a wide, circular frontage
that is bordered by the beginning of Hindman Park on
the north and a single family residence immediately to
the east. The sole use on this lot consists of a
single one story frame structure. There does not seem
to be any problems relating to drainage and other
public improvements.
B. DEVELOPMENT PROPOSAL
,J 1. The applicant is requesting a waiver that will
allow for a 4' addition to their present
residence, which will cause an encroachment of l'
into the 25' area established by a platted
building line. This proposal is based solely on a
need for more physical space within the home.
2. Conformance to Ordinance
The variance requested has been indicated above.
3 Legal Considerations
The need for an amended Bill of Assurance is the
only thing evident at this time. The owner has
been advised on the necessary procedure.
C. ENGINEERING CONSIDERATIONS
None.
D. ANALYSIS
Staff does not feel that the l' encroachment will have
an adverse impact on this or the abutting property.

Staff, however, is still concerned with maintaining
consistency in approach to this type of issue. We are
apprehensive about setting a precedent for future
propositions of this sort. To grant this request would
not be in conformance to the Ordinance.
As noted above, the owner variance is based on want not
need.
STAFF RECOMMENDATION
Denial on the grounds stated above.
SUBDIVISION COMMITTEE RECOMMENDATION
The Committee disagreed with staff's recommendation of
denial and passed a motion for approval subject to the
obtaining of the proper amount of signatures for an amended
Bill of Assurance. The vote was: 3 ayes, 0 noes, 3
absent.
PLANNING COMMISSION ACTION
`V The applicants were in attendance. There were no objectors.
The Commission made and passed a recommendation for approval
as filed. The vote was: 8 ayes, 1 nay and 2 absent.*
* Commissioner Massie voted no.
Commissioners Wright and Arnett were not in attendance.
