Street Improvement Variance
To be allowed to file a two lot replat and be exempted from
the requirement of curb and gutter on Western Hills Avenue
and cul-de-sac on east side of Lassie Lane.
STAFF REPORT
A visit to this site presents very little material evidence
that a variance is justified. The property to the south is
platted, developed and improved on all boundary streets.
The curb and gutter on Western Hills is completed to the
corner of this lot.
The termination of Lassie Lane at the west end of this tract
suggests that the Commission in approval of that plat had in
mind a continuation of Lassie Lane to Western Hills Avenue.
A development such as that which would involve the land
north of this owner's tract would be a better use of the
land. However, the two lot proposal present here with one
lot taking access on each street is not unreasonable. The
problem obviously is sufficient to street cause to obtain
two lots.
STAFF RECOMMENDATION
Denial of the requested variance.
SUBDIVISION COMMITTEE RECOMMENDATION:
Approval of the plat as filed. The owner has advised that a
plat will be required for Planning Commission review next
month and that improvements will be recommended for waiver.
The vote - 2 ayes, 1 no.
PLANNING COMMISSION ACTION:
The owner/applicant was present. There were no objectors.
The request was discussed at length, with the result that a
motion for approval as filed was made. The motion failed by
a vote of 2 ayes, 6 nays, 3 absent. A second motion was
made to approve a plat with no waivers. This motion passed
by a vote of 8 ayes, 0 nays, 3 absent.

STAFF RECOMMENDATION
Denial of the requested variance as staff believes this
exposed site warrants the larger dimension plus this issue
appears to be a one lot problem. We believe the lot in
question should be dealt with separately.
If a user proposes to keep the present structure we should
design to the site and its setbacks rather than making the
site fit a use/structure.
SUBDIVISION COMMITTEE RECOMMENDATION:
Approval as submitted, 25' building line, all of I-430
frontage. The vote - 3 ayes, 0 nays.
PLANNING COMMISSION ACTION:
The applicant, Mr. T. Moore, was present. There were no
objectors. A lengthy discussion was held, with the result
that a motion to approve as recommended by the Subdivision
Committee was made and passed by a vote of 8 ayes, 0 nays,
3 absent.
