WHITE I am one of the owners of the Danver's Restaurant on Cantrell Road and also the land lying behind Danver's that backs up to your property. We have made an application to the City to allow us to build some very nice apartments on this land (2.3 acres), and the City is going to con- sider our application on Tuesday, December 14, at 1:00 p.m. in the Board of Directors Room, 2nd floor of City.Hall. We were not obligated to notify the adjoining property owners, but we feel in the interest of harmony you should be advised of our request. Our apartment units will have their backs to you, and there will be no parking or traffic toward your property that would cause noise or dis- turbance. We are also required to allow 25 feet between the property line and the buildings; therefore, we are going to leave 15 feet of the thick vegetation at the property line undisturbed, and build a six-foot tall wood fence to provide additional privacy. I feel sure that you will consider us a good neighbor and assure you that our objective is to improve our property and yours also. If you have any questions or would like to look over the plans with me, please feel free to call and I will be happy to come by and explain it in more detail to you. The applicant, Mr. Ralph Bozeman, was present and offered comments in support of his case. There was one objector, Betty Womack, a resident to the north, who spoke to the issue of access on to Keightley Drive. The principle issue discussed was access, and the potential for gaining proper design and control of the access point. After a lengthy discussion, the Commission voted to approve the motion as follows: "Approval of the application, subject to the resolution of the access point onto Keightly Drive with the City Engineer and Fire Department and reserving improvement requirement possibility on both Kings Row and Keightly if such are needed, that need to be determined by the City Engineer's staff." It is our intention to construct 48 extremely nice apartment units on this property, and I have been working with the Plan- ning and Zoning Staff to insure that I comply with all zoning and subdivision regulations. The land is unusually irregular in shape and also very steep along the eastern section. It has demanded our full imagination to complete what I feel is a very acceptable solution. With this background, I am requesting that we be added to the December 14 agenda for Subdivision Site Plan Review. I have already requested a down -zoning from C-3 to R-5 to allow the project to be built as now drawn. A Subdivision Plat is be- ing prepared by Edward G. Smith, Engineer, and will be fur- nished to the Staff by December 3. Since the down -zoning request will be heard at the December 14 meeting, it would help greatly if we could also include the review necessary for the Subdivision Plat. The developers of this property are also the owners of the Danver's Restaurant, myself included, and I assure you we would want nothing done that would diminish our desirability or acceptability in the neighborhood. You will note from the enclosed plan that a 6-foot wooden fence has been provided where we abut residential property and also at the open areas around the Danver's parking lot to provide the apartments with privacy and protection.
