A. Existing Conditions
The site which lies adjacent to Rock Creek and in the
100 Year Floodplain (261' msl ) has been filled.
All public utilities, services, streets and drainage
have been provided previously.
B. Development Proposal
Five commercial lots are proposed to be served by a
50' access easement, which leads to the east entrance
drive of the K-Mart Shopping Center.
Tract "Z" is entirely occupied by the Rock Creek
Drainage Easement.
This property has been platted and replatted five (5)
or six (6) times, and this format is basically a
repetition of previous layouts, none of which have had
access to University Avenue and all of which took
access through the K-Mart property through the 50'
easement only.
The new Subdivision Ordinance makes several
W requirements that were not in effect during the
previous platting. They are: (1) 45' building lines
rather than 401, (2) 25' side yards (to be platted),
( 3 ) service easements to be built to public street
standards and subject to review by the Engineering
Division of Community Services Department, (4)
sidewalks on the service easement, (5) cul-de-sac on
the service easement.
C. Analysis
Most issues have been resolved by previous actions.
Usually, drainage easements remain a part of the
adjacent lots rather than occupying a separate tract.
Unless the City took title to Tract "Z", its status
would become nebulous. A consistent policy is
preferable.
D. Staff Recommendation
The staff recommends approval subject to:
1. 45' building lines

2. 25' platted side setbacks
3. Service easement to be to public street standards
(36' b to b) with sidewalks.
4. Include Rock Creek Drainage Easement and adjacent
lots.
Subdivision Committee Recommendation:
The Subdivison Committee recommends approval as
recommended by the staff, except for:
2. 15' platted side setbacks, rather than 25'.
3. Service easement to be 50' back to back, rather
than 36' with no sidewalks.
Planning Commission Action:
The applicant was present as was Mr. Williams, the
engineer. The staff presented expanded comments on the
issue of a service drive and its construction
requirements.
The applicant presented arguments to the effect that they
had not sold the lots and could not know in advance the
desired size, location or number of curb cuts.
After, a lengthy discussion of the proper approach to
resolve the difference, a motion was made as follows:
That staff and the owner meet and discuss their
differences. If an agreement can be reached, then the
plat is approved as agreed upon. If no agreement is
reached, the party (staff or owner) who desires that the
Commission review the case may ask for a rehearing at the
August Planning Commission meeting. The motion passed
unanimously.
