This proposal utilizes the zero lot -line concept of
development for five lots in the Tall Timber West
Subdivision, that are currently zoned for duplex use. The
owner is requesting a zoning change to "PRD" due to a
preference for individual ownership of each unit as opposed
to common ownership of the lots. Also included in the
rezoning is a sixth lot, which is to. be used for a single
family structure.
The single family attached structures will be built to
incorporate "passive solar heat concepts" and will be geared
toward the $35,000 to $45,000 market. The existing system
of public streets and pedestrian walkways are to be used;
and each unit will have a carport and drive, the equivalent
of two parking spaces. The plat and Bill of Assurance take
into consideration any previous covenants and restrictions.

PROPOSAL:
1. The construction of 11 units on 1.92 acres.

3. S ecial Re uest
(1) The applicant is requesting that the Commission
direct the staff to delay sending this item to the
Board until development plans are finalized.
SPECIAL REQUIREMENTS:
1. Sites considered under the Planned Unit Development
concept must be 2.0 acres or greater. This plan
complies.* (See Analysis.)
2. A minimum of 10 to 15 percent of gross "PRD" areas
shall be designated as common open space.
3. Guidelines for PUD's advocate the preservance of
existing trees whenever possible. The applicant has
stated intentions to comply.
4. A detailed landscaped plan must be submitted. This
plan complies.
5. Single family, duplex, zero lot -line and Townhouse
Developments shall have a minimum of 500 square feet of
usable private open space per unit.

ENGINEERING COMMENTS:
(1) Interior street improvements are in place.
(2) Highway No. 5 improvements have been previously waived.
(3) Show floodway limit on plat along the 65' drainage
easement line.
STAFF ANALYSIS:
Staff is favorable to this development, though several
issues need to be addressed. The actual site area is
somewhat short of the minimum PUD size requirement. This
poses no concern to the staff since adding the existing
street in the total acreage will more than adequately
compensate for the difference.
The site plan shows the proposed structural intrusion into a
40' setback area from State Highway No. 5. This 401 line
was established by the original Tall Timber West plat.
Since there is a 100' right-of-way on Highway No. 5, it will
not be detrimental to the property. To eliminate the
possibility of further encroachment of the same structure by
additional construction, the staff has requested that the
applicant plat the building site by showing the buildable
area of each unit, as done previously in the Woodland Hills
PUD.
Relative to the special request, staff is agreeable only if
the delay is granted for no more than 60 days.
STAFF RECOMMENDATION:
Approval, subject to comments made.
SUBDIVISION COMMITTEE ACTION:
Some questions were raised pertaining to the special request
and sixty-day limit set by the staff. The Committee decided
to extend this limit to 120 days. A motion was made and
passed that instructed the applicant to notify the staff of
the status of his development by the end of 120 days from
September 14th. If no notice is received, the staff is
authorized to send this to the Board. A motion was made for
approval, subject to comments made. The motion was passed
by a vote of 4 ayes, 0 noes,'and 1 absent.

PLANNING COMMISSION ACTION -
There were no o]ectors present. Mr. Bob Richardson was
present as representative. Afters a brief discussion of the
case, the Commission voted to recommend approval as
recommended by the Subdivision Committee. The vote: 7 ayes,
0 noes and 4 absent. l
NOTE FOR THE RECORD: Mr. Richardson advised the Commission
that he no longer equired a delay of submittal of the Board
of Directors, but that he desired the earliest possible
Board action.
