March 11, 1980 SUBDIVISIONS Item No. 1 - (DEFERRED MATTER) NAME: New Yorkwood Subdivision LOCATION: West of Warren Road between Mabelvale Cutoff Road and Camelot Drive DEVELOPER: ENGINEER: Ben Allen, Trustee G.A. Existing Conditions The site is practically level, dropping on the four (4) or five (5) feet to the east and west from the center. A major watercourse is adjacent on the west in a 40' easement. There are scattered trees and wooded areas. All utilities and public services are available. All adjacent streets, sidewalks and drainage have been built within the last seven (7) or eight (8) years in conjunction with the platting of the rest of Yorkwood. B. Development Proposal Conventional single family lots are proposed to be developed in what was originally platted as two (2) tracts of three (3) plus acres each. The lots are proposed to front to the north of Mabelvale Cutoff, a major arterial street and to the south of Camelot Drive. An annexation petition is currently being processed. The balance of Yorkwood remains out of the City. Mabelvale Cutoff adjacent was approved to the standard of one half of a 45' pavement and a 60' right-of-way. The new Master Street Plan requires half of a 48' pavement in an 80' right-of-way. It also requires an 80' building setback from the adjacent street centerline. C. Analysis The presence of an adjacent arterial street dictates an alternate development format. The new Subdivision Ordinance (37.24B) encourages the use of double frontage and reverse frontage lots with prohibition of vehicular access to the major street. This would possibly be achieved by introducing one (1) or two (2) very short cul-de-sac or loops into the interior of each block. D. Staff Recommendation The staff recommends that the plat be redesigned as above to provide double and reverse frontage lots with restricted access, that 10' additional right-of-way be dedicated to Mabelvale Cutoff and that the building line along the north side be moved to 80' from the street centerline. March 11, 1980 Item No. 1 - Continued A motion to deny the application as filed was adopted by a vote of 6 ayes to 1 no. Two motions followed. First, to adopt the staff recommendation which failed by 5 ayes to 2 noes. Second, to adopt the Subdivision Committee recommendation which failed for lack of a second. Subdivision Committee Recommendation (11-15-79) The applicants and their engineer were present. Discussion revolved around the inability of the staff and the applicants to arrive at a mutually agreeable recommendation. They suggested several possible designs which they preferred to the cul-de-sacs recommended by the staff. The Subdivision Committee voted unanimously to forward the matter to the Commission with no recommendation, but with a suggestion to consider the alternative of four large lots occupying the Mabelvale Cutoff frontage. Planninq Commission Action (11-27-79) The application was withdrawn by the owner shortly before the Commission meeting. Planninq Commission Action (12-18-80) Mr. Jim Carroll, of Block Mortgage Company, requested action on "New Yorkwood Subdivision" which had been withdrawn from consideration in November. Since attendance had declined to six members, it was decided to hold the matter over to the January meeting. Subdivision Committee Recommendation (1-10-80) The Subdivision Committee recommends approval subject to: 1) Vehicular access to lots fronting Mabelvale Cutoff to be by means of alleys to the rear of the lots; 2) Vehicular access prohibition easement with a substantial brick wall along the frontage. Planning Commission Action: (1-29-80) The owner's representative was present and expressed agreement with the Subdivision Committee recommendation. A motion to adopt the Subdivision Committee recommendation failed by a vote of 5 ayes, 2 noes, 1 abstention. Subdivision Committee Recommendation (2-12-80) Note: The Committee reconvened its meeting from the regular date (1-31-80) to the morning of the Commission meeting. Members attending were: Jack Davis, Willard Johnson, Jack Taylor and Richard Massie. The owners' representative was present. The discussion concerned the recommendation for cul-de-sacs as opposed to the proposal for alley access. A 21' alley and a 24' right-of-way were suggested as an alternative to a prior Committee recommendation. The Committee resolved to forward the application to the full Commission with no recommendation. Planning Commission Action (2-12-80) The owners, their engineer and architect were present. The Commission first voted on a motion to approve the plat with a 21' alley in a 24' right-of-way. It failed by 5 ayes to 3 noes. A second motion to defer the matter to the March 11, 1980 meeting passed by 8 ayes to 0 noes. Planning Commission Action Jim Carroll, representing the owners, was present to request deferral to the April 8, 1980 meeting. A motion to deny the application failed for want of a second. A motion to grant approval as previously recommended by the Subdivision Committee with a 21' alley was adopted by a vote of 7 ayes, 2 noes, 1 abstention (Mrs. Arnett).
