Request
To revise an approved preliminary.
STAFF REPORT:
This is a request by the applicant, Mr. James Cone, to waive
the requirement for a 40' buffer on the east side of Lot 11.
The request is based on the fact that:
1. Plans for the building to be placed 15' from the
adjoining property have already been made;
2. The single family property on this side is the only
remaining residential property in the area and will
inevitably be rezoned;
3. The office building on the east side of the property
has been approved and constructed with a 10' side yard;
4. Single family property, owner is requesting a rezoning
of this property to commercial and the "R-2" property
will be sold contingent upon this rezoning.
STAFF RECOMMENDATION:
Approval.
SUBDIVISION COMMITTEE REVIEW:
The item was reviewed by the Committee. Staff was requested
to notify the applicant, abutting neighbor, and Mr. Terry
Moore of the public hearing.
PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. Staff
identified the issue as involving a variance request for the
reduction of a previously committed 40' buffer to a 15'
building setback area.

During discussion of the item, it was pointed out that the
40' buffer was committed on the previous approval of a
preliminary, which was later sold without benefit of a final
plat. Thus, the applicant was in possession of an illegal
subdivision. Since the applicant was not aware of the
platted building line, he initiated plans for a building
that would encroach into this area.
After some discussion, a motion for approval of the
reduction of the 40' platted building line to 15' was made
and passed by a vote of 11 ayes, 0 noes and 0 absent.
