STAFF REPORT:
This is a proposal to revise Phase II of a PUD, which was
approved by the Planning Commission. The applicant feels
that the revised plan is an improvement over the earlier
one, since buildings and parking areas are sited to fit the
contours. This allows the developer to retain some trees
and ground cover previously proposed for removal, by
eliminating extreme cuts and fills in the plan. The result
is a decrease in the number of units from 37 to 36. Parking
spaces number 96, which is 2.67 spaces per unit.
Landscaping will meet or exceed Ordinance requirements.
ENGINEERING COMMENTS:
(1) None.
STAFF RECOMMENDATION:
Approval as revised, subject to proof of notification to
property owners.
SUBDIVISION COMMITTEE ACTION:
A motion in agreement with staff's recommendation of
approval, subject to proof of notification to property
owners was made and passed by a vote of 3 ayes, 0 noes,
1 absent and 1 abstention.*

PLANNING COMMISSION ACTION:
The developer was represented by Mr. Joe White of
Edward G. Smith & Associates Engineers. Mr. Chip Baker,
representing property owners in Phase 1 of the Development,
requested that it be deferred for 30 days. The Commission
felt that a two week deferral provided enough time for
developers and the owners to resolve their problems. A
question arose as to the notification of property owners.
Staff reported that proof of notification according to
Ordinance standards had been submitted. A motion for a two
week deferral was made and passed by a vote of 6 ayes,
0 noes, 1 absent and 1 abstention (abstaininq was
Ron Tabor) .
PLANNING COMMISSION ACTION: (9-28-82)
The applicant filed a written request for deferral of this
item inasmuch as the two weeks since the last meeting failed
to resolve the neighbors' objections. The Commission voted
to defer the case to October 12, 1982, by a vote of 11 ayes,
0 noes and 0 absent.
SUBDIVISION COMMITTEE RECOMMENDATION:
Mr. Joe White, the applicant's engineer, informed the
Committee that the developer is in the process of providing
maintenance to the drainage courses which would seek to:
alleviate complaints from owners in Phase I concerning
drainage problems. He also stated that several minor

and seven, and between one, two and three. A motion for
approval as revised was made and passed by a vote of 4 ayes,
0 noes, 0 absent and 1 abstention (Ron Tabor).
PLANNING COMMISSION ACTION: (11-9-82)
Mr. Joe White of Edward G. Smith and Associates represented
the developer. A motion was made to approve the revised
plan in accordance with the Subdivision Committee's
recommendation. The motion passed by a vote of 8 ayes,
0 nays, 1 absent, 1 open position and 1 abstention (Ron
Tabor).
