A. Existing Conditions
The site is lightly wooded and appears level. All
streets and utilities were installed under the original
industrial district approval.
All public services are available.
B. Development Proposal
Tract 77 is proposed to be split to yield two (2) lots
of 75' x 197' for retail use. The request is to permit
them to be developed to the setback standards of the
"C-3" zoning classification.
Minimum lot size requirements for commercial
subdivisions are 100' wide by 150' deep.
C. Analysis
According to the minimum Ordinance standards, Tract 77
is not large enough for more than a single building
site.
D. Staff Recommendation
The staff recommends that Tract 77 remain a single
parcel.
Subdivision Committee Recommendation (1-11-80)
The Subdivision Committee recommends the plat, as submitted
with interior setbacks, to be as specified in the "C-3"
zoning classification.
Planning Commission Action: (1-29-80)
The owner's representative was present. Discussion revolved
around the granting of variances from zoning standards in
the platting process and the Commission's authority or lack
of authority to grant such variances.
The Commission voted unanimously to defer the application to
the February 12 meeting to permit legal research on the
above issue.

Planning Commission Action: (2-12-80)
The owner's agent was present. The Subdivision Committee
submitted no recommendation from its reconvened meeting.
The staff conveyed an opinion from the City Attorney's
Office that zoning standards could not be waived as part of
the subdivision variance process.
The Commission voted on the application, which failed by
0 ayes to 9 noes.
