Existing Conditions The land involved is located in a generally wooded, hilly area that is bordered by Pleasant Valley Drive on the west side and Cantrell on the north. The area is mainly residential. Immediately to the east of the site is a residential home, and to the south are other condominiums. B. Development Proposal 1. This is a plan to build 24 condominiums; six buildings with four units each. The request includes two variances. One involves the reduction of a required buffer from 40' to 25' on the east side of the property. The other request is to eliminate the previously approved access on Highway #10. The reason for the buffer change is mainly to be able to provide ample off-street a parking for the residents. Parking spaces in front of the easternmost building would be eliminated with 40'. 2. Conformance to Ordinance The only variances from the ordinance are those noted above. 3. Legal Considerations None evident at this time. C. Engineering Consideration Improvements are in place, but there is minor concern regarding sufficient turnarounds for emergency vehicles. D. Analysis Staff has not found any problem with the first request for a reduction of the 40' requirement to one of 25' as provided by the earlier approval of the plat. The requirement has been changed to 25' minimum, in the ordinance. The developer has agreed to comply with the remainder of the ordinance and provide for the construction of a 6' opaque fence along the east property line. The second variance concerning the elimination of AP the Highway #10 access raises concerns about fire access and safety. The Fire Department does not feel that such an exemption would allow for adequate room for ingress November 11, 1980 SUBDIVISIONS Item No. 11 - Continued and egress of fire equipment, nor turnaround space. Staff would also like to see evidence of fire hydrant locations. E. Recommendation Approval after the above conditions are met. SUBDIVISION COMMITTEE RECOMMENDATION: Approval as recommended by the staff. The vote - 5 ayes, 0 noes. Staff recommendation was modified to accept the proposal that 10' patio intrusion be allowed and structural use be made of the 25' buffer. PLANNING COMMISSION ACTION: There were no objectors present. A representative was present. He stated that the question concerning fire safety had been answered, as their water plan proposed the fire y hydrants which were previously not shown. The Fire Chief approved of the access. A motion was madevand passed to approve the plat as presented. The vote was unanimous: 9 ayes, 0 noes, 2 absent.
